Mr. Ford stated that when the preli plans were filed, the subdivision regulations had just been <br /> amended. Initially there was no sidewalk on Route 130, but now there was a sidewalk and fir. Ford <br /> inquired whether the Board wished to include a sidewalk on the plan. <br /> Mr. l al arini referenced the open space and whether it would be considered private and Mr. Ford <br /> confirmed that it would be private property. Mr. Fudala stated that they could choose to give it to <br /> the Conservation Commission. Mr. Ford stated that they would explore the option with the <br /> Conservation Commission. Chairman waygan stated that it would be better if it went to the <br /> Conservation Trust. Mr. Bal rini inquired whether the open space was connected to town land. <br /> Mr. Fudala stag that land to the east was town owned and that it was looted within the National <br /> Wildlife refuge. Mr. Balzarini inquired about the front two lots and Mr. Ford confirmed that they <br /> were commercial. There was discussion regarding the location of sideways and the fact that it <br /> extended to Pickerel Cove, <br /> Chairman waygan referenced the open space and Planning Board members were-in agreement that <br /> there not be an easement but that the parcel be extended for the access. <br /> Mr. Fudala inquired about the mans why the 100 Foot center line radius could not be met. Raul <br /> Sadmee stated that the Bylaw identified the cul-de-sac as a perfect circle but that the plan included <br /> two 36 foot long straight lines making it a road, not a cul-de-sac. There was discussion about the <br /> radius of the circle and location of the center line. fir. Sadrnee sued that the centerline was 75 feet <br /> and Mr. Fudala stated that the Planning Board had never awepted a plan with less than a ]oo foot <br /> center line, adding that the original plan showed a larger cul-de-sac. Mr. Rowley staked that a <br /> standard cul-de-sac featured a 100 foot diameter. Mr. Sadmee sued that the diameter was <br /> approximately Zoo feet, but since it included tauigents, it wasnot considered a cul-de-sac and that a <br /> standard cul-de-sac would rice the froze of four lots. Mr. Rowley agreed that it did not <br /> c nfor m to tan sdard ul-d -sac. Mr. Rowley inquired whether the Fire Department and tr t r- <br /> trailers could negotiate the area. Mr. Fudala suggested that the:area fit the definition of a turn- <br /> around. Mr. Ford indicated that he would seek input from the Fire Department and loop into usage <br /> by tractor-trailers. Mr. Ford will also follow up with Mr. Rowley before submitting the definitive <br /> plan. <br /> Regarding the sidewalks, Mr. al arini noted that a sidewalk was available moss the street and Mr. <br /> `Fudala confirmed that the regulations required that at least one side of the road have a sidewalk. <br /> I1rlr. Fudala suggested that there may be uses in the development that would justify having a <br /> sidewalk available. Mr. Fudala inquired whether the Board wished to utifie the regulation or waive <br /> the regulation. Mr. Balzarini stated tl t he did not wish to waive the sidewalk. Mr. I ooharian <br /> agreed that uses could change over the years and that having a sidewalk would be beneficial. Mr. <br /> Mullin stated that he did not have a problem offering a waiver for the sidewalk- <br /> Mr. Balzarini inquired about the drainage. Mr. Rowley stated that it was a preliminary plan so it <br /> was assumed that it would handle only roadway drainage but calculations would need to be <br /> completed and every site would need to handle its own ru.nof . Mr. Ford stated that the Cape Cod <br /> Commission decision contained a condition that they would also review the engineering plans for <br /> erosion and sedimentation controls for the road. Mr. Rowley also noted that, at the definitive stage, <br /> it would be necessary to note that the layout of Rhian on's way would be rescinded or modified. <br /> 3 <br />
