.Dori Myers suggested clarification of the treatment <br /> plant be determined before this project roves forward. <br /> The Town Planner stated the condition requires <br /> satisfactory completion of this Phase prior to the issuance <br /> f occupancy permits for Phase III . <br /> The Board voiced concern with possible violation of <br /> the Special Permit, and possible adverse impacts to the <br /> Mashpee Fiver. , <br /> There was some discussion regarding responsi-bility, <br /> Mr. Nadzeika stated the treatment plant had been turned <br /> over to the Association two years ago. He also stated <br /> the Developer has posted a bond with the Town Treasurer. <br /> The Chairmanquestioned the entire process . <br /> The Town Planner stated this is a zoning issue, no D P <br /> standards have been violated, enforcement would be made by <br /> the Building Inspector as a zoning violation' . A court <br /> order would -be necessary in order to impose a daily fine in <br /> the event the 5 parts per million standard is not being <br /> met. <br /> The Chairman again expressed her concern for the <br /> condition of the Mashpee River, stating she feels this, <br /> entire matter needs to be clarified before any further <br /> aspect of this project can proceed <br /> Bennis Balarini expressed concern that the <br /> Association/Management Company are aware of the Special <br /> Perm- it standard of 5 parts per .milli n; not thie State <br /> requirement of 10 parts per million. <br /> It was the general consensus of the Board to continue <br /> this matter for thte'e-weeks during which time revision' <br /> could be made to the plan, Mr. O' Malley, President of the <br /> Association could be notified, and the Town Planner could <br /> obtain the necessary information/reports . <br /> The Chairman suggested the plant operator appear <br /> before the Board in order to present the operation of the <br /> plant, numbers, and adjustments . She expressed concern <br /> regarding Board responsibility to the environment and the <br /> s-ensitive nature of the Mashpee River. <br /> 7 <br />
