The Board expressed their reluctance to sign off on <br /> Phase II until such time as these concerns have been <br /> satisfactorily addressed. <br /> Mr. Quinn reiterated the Developer has no control over <br /> the `treatment plant, which has. been turned over to the <br /> Association as required (upon completion o-f construction of <br /> -units) . Nor does the Developer have any control over <br /> the actions. of t'he Association. He questioned the Board' s <br /> decision to prevent eleven (11) homeowners to move in, and <br /> to hold the Developer responsible for in actions of the <br /> Association. <br /> There was some discussion/question as- to whether or <br /> not the Association was notified in writing of Planning <br /> Board request for the appearance of the engineer. <br /> The cha-irm.an clearly stated that until. -such time as an <br /> engineer/monitoring company representative appear before <br /> the Board, as requested, they are unable to move forward on <br /> pending issues . <br /> Don Myers inquired as to the Board' s ability to allow <br /> authorization to close on a certain number of units between <br /> this date and that of the next meeting without providing a <br /> general approval* for Phase II . <br /> Mr. Quinn spore to the great efforts made by the <br /> Developer thus far to comply with the wishes of the Board, <br /> noting his dismay that owners will be preven-ted from moving <br /> into their homes . Be feels certain there is a reasonable <br /> remedy to the. issues of concern raised by the .Board. <br /> Don Myers requested a realistic number of closings <br /> with-ire the next two weeks, in order to provide some relief <br /> to the Developer. <br /> Mr. Quinn replied five (5) or six occupancy <br /> permits within the next two-week period would be helpful . <br /> Don Myers stated leis willingness to approve six <br /> units based upon the fact that joi,nt efforts will be made <br /> in order to remedy the situation/concerns . <br /> The chairman stated she feels it is imperative that <br /> the engineer appear before the hoard in order to provide a <br /> 7 <br />
