($1, o . oo) Dollars for reseeding efforts to be completed <br /> within the next six month period; which Motion was duly <br /> seconded by Dennis Balzarini and so voted unanimously. <br /> Hering determined this to be the free act and deed of <br /> the Planning Board, the Board Secretary notarized the <br /> Release of Covenant Agreement -signed by Beverly Kane, Lee <br /> Gurney, Steve Dolan, John Halachis, and Dennis- Balzarini . <br /> Board Item <br /> Discussion - Casper Circle <br /> Mr. Marsters stated he is representing Tony LaCava in <br /> this matter, he denied having any relationship/purchase and <br /> sale agreements on this property. <br /> He requested-. some direction from the Board as to their <br /> preference for access . <br /> References were being made to a plan entitled, <br /> "Preliminary Roadway Detail and Profile, located in <br /> Mashpee, MA, J L .LaCa a Realty Trust, dated February 10, <br /> 2004 , by Cape & Islands Engineering, revised April 30, <br /> 2004" . <br /> The 'Board deferred to the Consulting Engineer who <br /> explained he had inspected the property a number of times <br /> and expressed a- preference for the use of Old Barnstable <br /> Road, rather than Lowell Road, for safety reasons . <br /> The Chairman recognized Alan Morris who made the <br /> following points of consideration: Lowell Road has a <br /> sufficient radius for traffic, as emergency vehicles have <br /> proper access; a request for waiver of road width has been <br /> submitted to the Planning Board resulting in equal distance <br /> on both sides, in both proposals; the condominium access i <br /> the same entrance. His argument being that safety should <br /> not be identified as an issue of concern. <br /> The Town Planner reiterated the speed and volume of <br /> traffic on Lowell road are the issues of safety for <br /> consideration. <br /> The Consulting Engineer informed the Board of <br /> remaining concerns regarding the geometry coming out onto <br /> Lowell Road and what can be done given the limits of the <br /> property boundaries/minimizing the aftgle. His concerns <br /> 2 <br />
