The Chairman expressed her concern that the public <br /> right to access the ancient ways be preserved. <br /> Attorney Mcl lhinney suggested Applicant rake an <br /> inspection of the condition of the ways (obstructions, <br /> fencing) and report back to the Board. <br /> The re .being no further Board or public comment the <br /> Chairman entertained a motion. <br /> MOTION: Lee Gurney made a Motion to close the Public <br /> Hearings in the Defin,iti e subdivision Plan and special <br /> Permit matters; which Motion was duly seconded by Dennis <br /> Balarini and so voted unanimously. <br /> The Chairman entertained a motion be made with <br /> reference to the -Lot Definitive Plan. <br /> MOTION: Steve- Dolan made a Motion to approve the - <br /> Lot Subdivision Plan entitled, "Definitive Subdivision <br /> Plan, Fin' Me Oot Road Modified Subdivision, Willowbend <br /> Country Club, dated November 2, 2004 subject to the <br /> following Conditions - soil testing outlined in letter <br /> dated November 2, 2004 , Charles L. Rowley, PE, RLs, Water <br /> Quality Deport as- required by the Zoning Bylaw, written <br /> documentation from Board of selectmen regarding approval of <br /> road relocation, removal of rounds within the roadway, and <br /> covenant to be attached to the plan; which Motion was <br /> duly seconded and so voted une-nimously.. <br /> The Chairman them entertained a motion be made with <br /> reference to the special Permit. <br /> MOTION: Steve Dolan made a Motion to approve the <br /> modification to the special Permit to include the following <br /> Conditions - soil testing outlined i-n letter dated November <br /> 2004 , Charles L. Rowley, PE., RLs, Water Quality Report as <br /> required by the Zoning Bylaw, written documentation from <br /> the Board of Selectmen rega-rdi-ng approval of road <br /> relocation, removal of mounds within the roadway, a <br /> covenant to be attached t.o the plan, signage to mark the <br /> ancient ways (a proposal to be presented -to and approved by <br /> the Board ; which Motion was duly seconded by Dennis <br /> Balaini and so voted unanimously. <br /> Public Hearing <br /> Lincoln Gray Realty 'gust <br /> 8 <br />
