W-illowbend, subject to a long-term restriction i <br /> perpetuity. <br /> F Steve Dolan inquired as to whom is responsible for the <br /> mound obstructing access t Simons Road. <br /> Attorney McIlhinney responded the approved plan shows <br /> the mounds to be eliminated and replaced by evergreen <br /> screening. There is a stipulati n that Simons Road will be <br /> maintained as a way open to the public, with no obstacles, <br /> fences or barriers to passage. <br /> Steve Dolan asked if Applicant intends to keep the <br /> road open. <br /> Attorney McIlhinney replied, "Yes, throughout the <br /> extent of our ownership" . "We would maintain Simons Toad <br /> as open, plow it in the winter and maintain it as a public <br /> passageway" . <br /> The Chairman informed Appli-cant of the letter received <br /> from a concerned citizen addressed to Joyce Mason, subject <br /> being- acess to Mashpee' s ancient ways . "Dear Ms . Mason, <br /> e have recently been informed that w.e are not allowed to <br /> walk on their roads in the Shoestring Bay road area . l't is <br /> my understanding that -several years, ago the Town determined <br /> that ancient ways could not be abandoned and that tesideftts <br /> have a right to transverse these paths. ryant' s Cove Read <br /> starts at the intersection of Quaker Run and Simon' s <br /> ]arrows Road. It is plainly marked on all our maps. In <br /> addition, Simon' s Road actually starts at Route 28 and <br /> proceeds south and meets Bryant' s- Cove Road. I know- some <br /> of the ancient ways were actually removed during the <br /> original development of Willowbend fifteen years ago and as <br /> a result of this action was taken. to preserve or allow <br /> access to these paths . I would like your clarification on <br /> this situation. we have been walling in these areas for <br /> thirty years and a-re upset that our access to these old <br /> paths is being challenged. I look forward to hearing from <br /> you . <br /> Attorney McIlhinney responded by stating it is not <br /> their intent to interfere with the right of access to any <br /> of these roads. Applicant has agreed to maintain said <br /> roads as a public access way. Slight adjus-tments have been <br /> made throughout the process to relocate some of the ancient <br /> wags in order to accommodate the golf course. <br />
