The- Town Planner explained there had been a previously <br /> approved subdivision plan on the Sconset Village <br /> Subdivision property for 4. -1 is called Greenfield Estates, <br /> Said plan and covenant remain on record. The attorneys <br /> involved are looking to have the plan and covenant <br /> rescinded. <br /> The Chairman recogni ed . Jeanne Gillis, representing <br /> Brian Dacey, Trustee of Sconset Tillage Development Trust . <br /> Attorney Gillis provided copies of the original 1985 <br /> plan on record, she confirmed the covenant thereto remains <br /> n record and has never been r.elased. <br /> Attorney Gillis explained that her client has taken <br /> title' in 2001 and that his predecessor in title had <br /> obtained .-approval of a tool subdivision plan that was <br /> recorded with an identical covenant attached, and which has <br /> since been released. • <br /> Attorney Gillis provided copies of the 1985 plan, as <br /> well a-s the new tool .s.ubdivision -plan. She further <br /> explained that no (road) construction of any kind had ever <br /> begun on the 1985 plan, nor had any parcels been deeded. <br /> Attorney Gillis suggested the Board sign a certified <br /> copy of the vote, to be attached to the 1985 plan. <br /> • <br /> MOTION: Leo Gurney made a Motion to rescind the <br /> approval of a plan recorded in the Barnstable County <br /> Registry of Deeds in Plan Book 411, Page 48, dated <br /> September 4, 1-98.5, and the release of the Covenant recorded <br /> in said Deed Book 4924, Page 100, dated October 15, 1985 to <br /> which this plan is subject. Said modification amendment <br /> and rescission aloes not effect any lots -or rights <br /> appurtenant thereto in said subdivision which lot was <br /> conveyed or mortgaged in good faith and for valuable <br /> consideration subsequent to the approval of a subdivision <br /> plan Mass .General Lags Ch. 1., Section 81 ; which Motion <br /> was duly seconded and so voted unanimously. <br /> Having determined this to be the free act and deed of <br /> the Board, said Notice of Planning Board Vote in connection <br /> with Modification, Amendment or Ieciss ion of Plan M. . L. . <br /> h. 41 Section 81W., was duly notarized by the Board <br /> Secretary. <br /> 1 <br />
