r <br /> Attorney Kirrane reported that the plan has been <br /> revised, as was previously suggested by the Board, to <br /> include an emergency access date. The Board had also <br /> requested at that time that Attorney Kirrane provide a <br /> proposed restriction covenant upon the owners succes ors in <br /> title the obligation to maintain said access which is to be <br /> cleared of any snow/ice conditions . <br /> References were being made to said reprised plan. <br /> There was some discussion regarding the use of signage on <br /> said ga-te, "Do Not obstruct Gate". <br /> Attorney K.irrane stated that if the proposed property <br /> were developed, someone would be on site at all times a-nd <br /> would be respons:ibl.e for maintaining the access. <br /> Dennis Bal grin-i inquired about Planning Board <br /> liability in the event of an obstruction to access in an <br /> emergen y situation. <br /> �eneral <br /> It was the consensus of the Board, and <br /> Attorney Kirrane agreed, that the Deputy Fire chief would <br /> approve the gated access reluctatly) , although he would <br /> prefer the access not be- gated. <br /> The Town Planner requested approval for Town counsel <br /> review of the document entitled, "'Voluntary Restriction - <br /> Covenant" submitted to the Board by Attorney Kirrane. His <br /> concern being enforcement issues . The Board agreed. <br /> Attorney Kirrane recommended the Planning Board make <br /> written comment upon the special permit application when it <br /> is filed with the Zoning Beard of Appeals . He suggested a <br /> condition be included within the special permit, if <br /> granted, that would impose upon the owner of the property <br /> responsibility to maintain a clear access. If said <br /> condition is violated, the Building Inspector would have <br /> the au-thority to enforce. <br /> The Town Planner suggested the language be amended to <br /> grant enforcement authority to the Town of Iashpee Fire <br /> Department; to which Attorney Kirra-ne agreed; and which <br /> amendment be submitted for Town counsel review. <br /> The Chairman insisted said access gate be clearly <br /> marked, .,Emergency Access-Do Not Block.. to be shown on the <br /> plan, with yellow striping to indicate caution. <br />
