r
Attorney Kirrane reported that the plan has been
revised, as was previously suggested by the Board, to
include an emergency access date. The Board had also
requested at that time that Attorney Kirrane provide a
proposed restriction covenant upon the owners succes ors in
title the obligation to maintain said access which is to be
cleared of any snow/ice conditions .
References were being made to said reprised plan.
There was some discussion regarding the use of signage on
said ga-te, "Do Not obstruct Gate".
Attorney K.irrane stated that if the proposed property
were developed, someone would be on site at all times a-nd
would be respons:ibl.e for maintaining the access.
Dennis Bal grin-i inquired about Planning Board
liability in the event of an obstruction to access in an
emergen y situation.
eneral
It was the consensus of the Board, and
Attorney Kirrane agreed, that the Deputy Fire chief would
approve the gated access reluctatly) , although he would
prefer the access not be- gated.
The Town Planner requested approval for Town counsel
review of the document entitled, "'Voluntary Restriction -
Covenant" submitted to the Board by Attorney Kirrane. His
concern being enforcement issues . The Board agreed.
Attorney Kirrane recommended the Planning Board make
written comment upon the special permit application when it
is filed with the Zoning Beard of Appeals . He suggested a
condition be included within the special permit, if
granted, that would impose upon the owner of the property
responsibility to maintain a clear access. If said
condition is violated, the Building Inspector would have
the au-thority to enforce.
The Town Planner suggested the language be amended to
grant enforcement authority to the Town of Iashpee Fire
Department; to which Attorney Kirra-ne agreed; and which
amendment be submitted for Town counsel review.
The Chairman insisted said access gate be clearly
marked, .,Emergency Access-Do Not Block.. to be shown on the
plan, with yellow striping to indicate caution.
