He did state that new rnemb rs are needed and'he feels this is a <br /> perfectly legitimate reason to appear before the Board with this modification. There are <br /> approximately l -acres of dedicated open space which many of the residents/abutters <br /> walk through and enjoy every clay, which land-is entitled under zoning to-be counted in <br /> determining the allowable density calculation. <br /> Attorney McElhinney stated that there hAve been no formal filings made with the <br /> Zoning Board of Appeals and this is the reason there are no plans available for refer. <br /> He stated that as soon as the revised plans before the Planning Board were received from <br /> Baxter NyeEngineering, they were submitted to the abutters. <br /> Forma Lyons, 33 Cranberry Ridge load—Informed the Board that at the time <br /> she purchased her property-she was told by the real estate went and her neighbors that <br /> the soccer field would be there forever and that there would never be a house built there. <br /> Deborah Hoshus—.Mated her preference for the construction ofsingle-family <br /> hones and for the-elimination of four bui ldings to be relocated onto other lots owned-by <br /> the Applicant and that are available for construction. She also requested that the woods <br /> and dirt road remain-unchanged; and that the Board deny the request for modification. <br /> David wood informed the Board that he net recently with Scott and Deb Travis- <br /> , in order to discuss their concerns. However, there were no firm commitments made at <br /> that time,but discussion did take place. <br /> There being no further Board, Staff, or Public comment the Chairman entertained <br /> a motion for continuance. <br /> MOTION: Dennis Bal arini made a.Motion to continue the Public Hearing in <br /> this matter,to April 1, 2009 at 7:1 o p.r .; which notion was duly seconded by James <br /> Leonard and so voted unanimously. <br /> (At-this point the Chairman declared a -minute recess. The February 1 , 2009 <br /> Planning Board Meeting was reconvened at 9: 0 p.m. <br /> Special Permit <br /> Mashpee Investors LL — Special Permit Modification to convert Joy Street <br /> Pedestrian Walkway to Street and Parking Area <br /> The Chairman stepped down from this matter and left the meeting room, <br /> appointing the vice Chairman to preside over this matter. <br /> Dennis Balza-irli called this matter to order and deferred to the Town Planner who <br /> made reference to a letter received from Town Counsel expressing his opinion of the vote <br /> taken in this matter. <br /> 10 <br />
