Mr. Bowleg reported that he has inspected each of these properties and that his <br /> only concern is that each of the bounds along the streets has been set. 11rIr. liarsters has <br /> provided a letter dated March 5, 2009, from Cape & Islands stating that all of the bounds <br /> he was asked to inspect have beer-installed. <br /> The only outstanding issue is the connecting road between Spring Hill west,and <br /> Fox Hill', a portion of'the development that was part of Spring Mill west that was meant <br /> as an emergency access between the two,, but was-never constructed. Thi s i ssue is part of <br /> the final approval for the project because it is part of the approved subdivision plan. <br /> The Town has completed/paved a small portion of Fox Dill using some of the <br /> security monies. However, the wooded strip between the two developments has never <br /> been constructed and there-is no way to get through. <br /> The Town Planner stated that David way has been stripped and cleared and is <br /> being used by a neighbor as garden space. This street was never constructed and which <br /> could access one.lot. The requirement within the Spring Dill west development was to <br /> construct a connecting dirt road to David way as an emergency access because their cul- <br /> de-sac length exceeds the zoning bylaw requirement. <br /> Deference was then trade to Condition 94 of the Special Permit: ` Condition# <br /> shall be-modified to include the following additional language--until such tine as the <br /> Town of l ashpee by and through its Department of Public worts has constructed I vid <br /> Way, consistent with the profiled plans dated February.1 ,. 199, sheet 4 of 4, the <br /> Applicant, its successors and assigns shall be relieved of its responsibility and obligation <br /> to construct the emergency access as shown on those same approved profile plans. <br /> Nothing contained herein shall preclude the Applicant or its successors and assigns from <br /> continuing to develop the subdivision.in obtaining the appropriate lot releases from <br /> covenants upon completion of the roadways shown on the aforementioned plan or the <br /> posting of security in a form acceptable to the Planning Board. Signed March 3, 199 ." <br /> Mr. l rlarsters-argued that it is the responsibility of the Town of 1 iashpee to <br /> construct the road. Said road has existed since 001J t.is a cul-de-sac and there have <br /> been no issues raised by the neighbors. The Applicant has never been instructed to <br /> construct David way and should have nothing to do with the release of road covenant. <br /> It was the general consensus of the Board that these are two separate issues and <br /> that the performance bond se..curityis not connected to the David way roadway as shorn <br /> on the subdivision plan. <br /> MOTION: Dennis l al an'ni made a Motion to release the performance guarantee <br /> in the amount of$20, 049.00 (plus accrued interest) with regard to Spring Hill West; <br /> which Motion was duly seconded by Al Wick el and so voted unanimously. <br /> Quashnet valley Area C <br />
