(relieving.lames Leonard); which Motion was duly seconded by James Leonard and so <br /> voted unanimously. <br /> Perfurrnance Guarantee <br /> Ri'Chard Pasciuto-Assessors Map 21, Block 52 <br /> Corner of.Silver-Leaf Lane and Fox Hill Toad <br /> .discussion of Road Construction Requirements for-Road Covenant Rdldase <br /> The Chairman called this matter to order and recognized the Applicant, Richard <br /> Pasciuto. <br /> The Town.Planner explained this subdivision vas.approved in the 1 's, but was <br /> never completed. The base coursci .-and some drainage and utilities were constructed. The <br /> lots have been.sold in violation of the-road covenant to various buyers. As owners have <br /> warted-to build houses, sections of the development have been completed, as required <br /> and approved-by the.Planning.board to be Paid by the owners . There have been <br /> .approximately seven, "sections of'the roadway that have been completed, with some <br /> sections that.have not been constructed. <br /> Mr. Rowley indicated on the map those areas where the roadwork has,been, <br /> completed; noting however that inspections.were never made. <br /> The Town Planner informed the Board that here is a surety to cover the <br /> construction that should have been completed, from Western.Surety Company, vhi ch,has <br /> Proven to be,difficult to cash (and requires legal advice/fees from Town Counsel), for <br /> Silver Leaf Lane between Fox Hill road and the western propel'line of Lot 52. <br /> The section of Balfour Lane to S.i.lver Leaf Lane has-been paved. The portion of <br /> -road between Balfour and SouthSandwich-Road contains no lots that would ever require <br /> frontage. <br /> Mr. Rowley agreed that those two portions on Silver Leaf Lane along with a small <br /> section of Candle good remain to be finished. There is-also a section at the end of Fox <br /> Hill Road to be paved. <br /> Dennis alarirui suggested the Board agree on a fair construction price that the <br /> property owner would be responsible for. <br /> t this point the Chairman recognised Rich Pasciuto who indicated on the neap <br /> the location of his lot.and.that portion of the roadway that-remains unpaved. He <br /> commented on the condition of the roa way , noting that the intersection has been <br /> washed out,'and also indicating the location of the dirt road. He made-reference to the <br /> andl wood section of the subdivision noting that it is washed out as well. <br />
