ti <br /> The Town Planner made reference-to his e-mail dated August 24th addressed to <br /> the Applicant listing the Special Permit Conditions, as well as Mr. Rowley' most recent <br /> inspection report dated August I" with regard to engineering and landscaping i <br /> 3) ssues. <br /> The Chairman recognized Stuart Bornstein who informed the Board that all of the <br /> Conditions have been met; with the exception of two items. <br /> Applicant stated that twelve 1 arborvitae trees are missing from the property, <br /> and that two trees have died. He stated that he plans to have a trailer truck load of trees <br /> delivered ppro hn tely -trees, -ft. tall for vari uis projects to be planted in October. <br /> The Chairman made reference to item 42 of Mr. owley's letter-, "No work has <br /> been done at the location ofthe second foundation!,the proposal at the last inspection was <br /> to protect the site from sediment and erosion to the new pavement; and to loam and seed <br /> the area as indicated on the approved plans. There is still a significant amount of <br /> construction materials within the foundation area. The foundation has been cordoned off' <br /> with construction fencing around the perimeter." <br /> Mr. Bornstein stated that this matter has been addressed. All of the construction <br /> materials has been removed and stored away. Applicant intends to appear before the <br /> Planning Board within a few months to request approval for modification of the building <br /> design from a ore-story building to two-story. <br /> The Town Planner noted that the vegetation, driveway and parking, underground <br /> utilities issues have been addressed. Condition#19 requires a gate at the property, prior <br /> to the issuance of an occupancy permit, which has not been installed. <br /> Mr. Bornstein replied, "We are not going to put a gate on that at the moment. We <br /> have no tenants in there...origxrn lly it called for a gate and we thought we'd have self- <br /> storage upstair and right now there is no reason to put a gate on. There are no controls, <br /> no way to open it and it is not necessary." <br /> The Town Planner explained that this item is required under the Special Permit. <br /> He suggested the appropriate approach would be to modify-the Special Permit ire order to <br /> eliminate this Condition, which would require a vote of the Board at a Public Nearing. <br /> It was agreed that Applicant would install a gate of some sort in order to <br /> favorably meet the Condition imposed by the Special.Permit in order to obtain an <br /> occupancy permit: to which Applicant agreed. <br /> The Town Planner suggest Applicant's engineer modify the site plan to indicate <br /> the type of gate being installed to be forwarded it to Ir. Rowley, which would be <br /> considered a minor modification, to be addressed at the next meeting and would not <br /> require a Public Hearing. <br /> 6 <br />
