Applicant has one-year to file a formal application after the Notice of Intent has <br /> been submitted and approved by the Commission. Nlashpee Commons is currently at this <br /> stage of the process. Pre-application meetings have been conducted between the <br /> Applicant-and Commission Staff(Commission Members have not been present at these <br /> meetings). Open Meeting Laws do not apply as there have been-no Commission <br /> Members present/no quorum of the govermnental body. These meeting have been <br /> conducted basically to review the Regional Policy flan with Staff`#: In.response to <br /> Planning Board request, notification will be made with regard to scheduled meetings in <br /> the event the Town Planner and/or Consulting Engineer would like to attend. <br /> Upon'completion of the pre-application meetings, Applicant is free to submit an <br /> application, at which point a subcommittee of the Commission will be empanelled, at <br /> which point the Cape Cod Commission subcommittee and the participating parties will <br /> conduct a joint Public Nearing. The Cape Cod Commission Act, Regional Policy Plan, <br /> Local Comprehensive Plan, and local zoning will be reviewed. <br /> The Cape Cod Commission subcommittee would then conduct separate meetings <br /> in order to review the development for consistency with the Cape Cod Commission Act, <br /> Regional Policy Plan and the Local Comprehensive Plan. The Town would also conduct <br /> its.own eparate process whereby it would review-the development for consistency with <br /> local zoning, Local Comprehensive-flan,as well as applicable stag law. <br /> The purpose for the two separate meetingsprocesses is to identify areas of <br /> compliance or non-compliance with issues-identified at the joint Public Hearing. when <br /> this process is completed,the Cape Cod Commission subcommittee, Town and Applicant <br /> will meet again to reconcile any conflicts. At this point the subcommittee would direct <br /> Cape Cod Commission Staff to draft a Development Agreement. <br /> I&. I eid wiecl i indicated that he feels the joint meetings should be held at the <br /> local level and chaired by the local committees (during the evenii'g). <br /> Phi l Iascomb spore to open space provisions and options. Requirements can be <br /> met on-site, off-site, or under certain restrictions through cash contributions. The amount <br /> of open space requirement is determined by location. One being whether you are within <br /> a significant natural resource area SI TF ; or an Economic Center within a Land Use <br /> Vision Map. <br /> If the location is within an SNRA twice the arnount of developed area is required <br /> for open space purposes; half the developed area is required for open space outside an <br /> S R..A. Any open space provided through this process however has to be an equivalent <br /> natural resource values to the area being disturbed. <br /> It is his understanding that the choice of ors-situ off site.land is s mething that <br /> can be proposed to the Commission by the developer. "There is some Commission <br /> discretion regarding acceptability of-a dash contribution. The Commission would seer <br /> input from the Town regarding a cash contribution in lieu of land. <br />
