Bush, Trustee requesting <br /> a Written Finding under §174-17 & §174-20 of the Zoning By-laws concerning <br /> continuance,extension or alteration of a pre-existing,non-conforming structure to raze and <br /> replace a single-family dwelling located on property in an R-5 Zoning District at 55 Santuit <br /> Lane, (Map 30 Parcel 2), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on October 24, 2014 and October 31, 2014 a <br /> copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on March 25, <br /> 2015 at which time the following members of the Board of Appeals were present; Mr. <br /> Jonathan Furbush, Chairman, Richard Jodka, Board Member, and Associate Members <br /> Dom DeBarros and Scott Goldstein. <br /> Greg Bush applied for his raze and replace project late last year. At his first initial <br /> hearing on November 12,2014,the Zoning Board of Appeals told him he required a current <br /> site plan, and approval from both Board of Health and Conservation prior to returning to <br /> the Board of Appeals. As requested by the Board, he submitted several continuance letters <br /> and was ready to return on March 25, 2015. <br /> Mr. Bush told the Board that he has owned a landscaping business for the past 20 <br /> years and that 95% of his business is in Mashpee. He currently lives on a busy road in <br /> Marstons Mills and would like to move back to his property in Mashpee that he has owned <br /> for a few years. He spoke to an architect who advised him to take down the old structure <br /> because it would be more costly to retrofit an older house than to start new especially since <br /> the building codes have changed. <br /> 1 <br />
