MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR WRITTEN FINDING <br /> Gregory S. Bush, Trustee <br /> 55 Santuit Lane (Map 30 Parcel 2) <br /> Mashpee, MA 02649 <br /> FINDING-2014-54 <br /> Mr. Furbush wanted to confirm that he is not looking for any setbacks. He asked <br /> what the height of the new house would be. Greg did not submit house plans because he <br /> wanted to make sure he was given approval by all the Boards. Mr. Furbush told him that <br /> the height should not exceed 35 feet of the average grade of the lot. Mr. Goldstein said his <br /> architect and engineer should know the bylaw. The Building Commissioner will require a <br /> certified height submitted by the engineer, and if it's over the requirement, it will need to <br /> be corrected. Greg said he likes the position of the current house with the surrounding <br /> landscape, and wants to keep the same look with his new house. <br /> Mr. Furbush read the Board of Health comments into the record; "55 Santuit Lane <br /> — Septic was approved with testing and operations and maintenance requirements for the <br /> denitrification system." <br /> Mr. Jodka read the Conservation comments into the record; "Approved by the <br /> Conservation Commission." <br /> GENERAL FINDINGS: <br /> The subject property located at 55 Santuit Lane is approximately 10,585 square <br /> feet. <br /> There were no abutters present. <br /> WRITTEN FINDING CRITERIA: <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or <br /> uses may be continued, although not conforming with the provisions of this chapter. Non- <br /> conforming single- or two-family dwelling structures may be changed, extended or altered <br /> if such change, extension or alteration complies with the dimensional requirements <br /> applicable to the lot under current provisions of §174-31 or, for lots which have been <br /> developed pursuant to §174-21, complies with such requirements as were applicable to <br /> initial construction of the dwelling under provisions of§174-21. <br /> Changes, extensions or alterations of non-conforming single- or two-family <br /> dwelling structures which do not meet the applicable dimensional requirements as set forth <br /> above, and changes, extensions or alterations of all other non-conforming structures, or <br /> non-conforming uses, may not be made unless there is a Written Finding by the Zoning <br /> Board of Appeals that such change, extension or alteration shall: <br /> 2 <br />
