MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR WRITTEN FINDING <br /> Gregory S. Rebuilding of Destroyed or Damaged Nonconforming Structure Any <br /> non-conforming building or structure destroyed or damaged by fire, flood <br /> lightning,wind or otherwise may be rebuilt, subject to approval of the Board of <br /> Appeals subject to the same conditions as set forth in §174-24 of this chapter. <br /> SPECIFIC WRITTEN FINDINGS: <br /> The Board determined that: <br /> 1. The proposed new dwelling will not be substantially more detrimental than the <br /> existing non-conforming structure or use to the neighborhood. <br /> 2. The dwelling will be an improvement to the lot and is similar in size and character <br /> to other existing structures in the neighborhood. <br /> The Board conditions this Decision upon receiving an updated plot plan to depict the <br /> following: <br /> -Correct end of driveway (from right of way) <br /> -Flood Zone Designation <br /> -Wetland Delineation <br /> -Zoning Classification: R-5 <br /> -The space between the deck and the house is being filled in which is increasing <br /> the lot coverage from 10.6%, to 11.8%which does not affect the setbacks. <br /> -Legend <br /> -General Notes (as listed on the proposed plan) <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Written Finding. Upon motion duly made and seconded at the Public Hearings on March <br /> 25, 2015. The Zoning Board of Appeals voted unanimously to grant a Written Finding <br /> under §174-17 & §174-20 of the Zoning By-laws concerning continuance, extension or <br /> alteration of a pre-existing, non-conforming structure to raze and replace a single-family <br /> dwelling located on property in an R-5 Zoning District at 55 Santuit Lane, (Map 30 Parcel <br /> 2), Mashpee, MA.
