MASHPEE ZONING BOARD OF APPEALS <br /> David M.Ferris&Ana S.Ferris <br /> 36 Seconsett Point Road(Map 124 Parcel 38) <br /> FINDING-2013-10 <br /> 23 Minimum required setback from rear or side property lines shall be five (5) feet for sheds or <br /> similarly noninhabitable structures not exceeding 120 square feet in floor area or twelve (12) feet <br /> in height. <br /> History: Added 10-17-2005 ATM,Article 13,approved by Attorney General 3-7-2006 <br /> Specific Written Findings: <br /> The Board determined that the proposal shall not be substantially more <br /> detrimental than the existing non-conforming structure or use to the <br /> neighborhood, as defined under §174-31 of the Zoning By-laws and is <br /> conditioned upon the following: <br /> • The new structure will be an improvement and will conform to current <br /> building code requirements. <br /> • It is compatible in size and character to other structures in the <br /> neighborhood and there is sufficient parking and setbacks as may be <br /> required. <br /> • References the Board of Health Statement; Not in Zone II. The leaching <br /> facility will accommodate up to five (5)bedrooms. <br /> • References the revised plan that depicts the exact location of the driveway, <br /> the proposed new raised patio and any other objects that may affect the lot <br /> coverage, as well as the exact dimensions of the lot to be proposed and <br /> submitted to the Zoning Enforcement Officer prior to construction. <br /> • A driveway which depicts a maximum measurement of 14 feet wide at <br /> each end with no further work beyond the boundary lines of the lot. <br /> In view of the foregoing, the Board determined that the Petitioner met the <br /> criteria for a Written Finding. Upon motion duly made and seconded at the Public <br /> Hearing on April 24, 2013, the Zoning Board of Appeals voted unanimously to <br /> grant a Written Finding to allow for the proposal. This Decision is contingent <br /> upon compliance with plot plans that refer to this project drafted by Cape & <br /> Island Engineering, 800 Falmouth Road, Suite 301C, Mashpee, MA 02649, <br /> revised plot plan dated April 26, 2013, prepared for Ana Ferris, signed by David <br /> Charles Sanicki, Registered Professional Land Surveyor. <br /> 6 <br />
