Town of Maslipee <br /> 1N rtpr�{p' 10 Crvat<}V ek l oacl worth <br /> 1l'osIgxe,Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> SP-2013-11 <br /> Rachel Martin Hicks et al Tr, Title Reference Book 24347 <br /> Hicks Family Revocable Trust Page 168 <br /> 47 Orchard Road <br /> Map 62 Parcel 3 <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 28, 2013 by Rachel Martin Hicks, et al Tr, <br /> Hicks Family Revocable Trust requesting a Special Permit under §174-20 of the <br /> Zoning By-laws concerning rebuilding of destroyed or damaged non-conforming <br /> structures to raze and replace a single-family dwelling on property located in an <br /> R-3 Zoning District at 47 Orchard Road (Map 62 Parcel 3), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The Mashpee <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, on April <br /> 5, 2013 and April 12, 2013, a copy of which is attached hereto and made a part <br /> hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to <br /> the provisions of Massachusetts General Laws Chapter 40A §9 and the Town of <br /> Mashpee Zoning By-laws. <br /> On April 24, 2013, Public Hearings were held on the Petition at the <br /> Mashpee Town Hall at which time the following members of the Board were <br /> present and acting throughout: Board Members, Jonathan D. Furbush, William A. <br /> Blaisdell, Ronald S. Bonvie, James Reiffarth, Judith Horton and Associate <br /> Members John M. Dorsey and Domingo K. DeBarros. Also present was Richard <br /> E. Morgan, Building Commissioner. <br /> John Slavinsky of Cape & Island Engineering represented the Petitioner <br /> and submitted the proposed plot plans developed and prepared by Cape & Islands <br /> Engineering dated March 28, 2013 by David Charles Sanicki, Registered <br /> Professional Land Surveyor. <br /> No comments were received from abutters. <br /> 1 <br />
