MASHPEE ZONING BOARD OF APPEALS <br /> Rachel Martin Hicks et al Tr, Hicks Family Revocable Trust <br /> 47 Orchard Road, (Map 62, Parcel 3) <br /> SP-2013-11 <br /> General Findings: <br /> The plans depict the current structure to be razed as well as removal of the <br /> current septic tank, and the proposed new three (3) bedroom dwelling to be built <br /> approximately 8% of the total lot coverage of 14,500 square feet. The new <br /> dwelling will be situated 45 feet fiom the front, 23 feet on both side setbacks and <br /> a height of 35 feet with adequate parking. A 10' x 12' shed will also be <br /> constructed. The driveway is within the boundary lines of the property. <br /> Specific Findings: <br /> Special Permit under § 174-20 of the Zoning By-laws concerning <br /> rebuilding of destroyed or damaged non-conforming structures to allow for <br /> rebuilding of a single-family dwelling on property located in an R-3 Zoning <br /> District at 47 Orchard Road, (Map 62 Parcel 3), Mashpee, MA. <br /> In view of the foregoing, the Board determined the Petitioner met the <br /> criteria for a Special Permit. Upon motion duly made and seconded at the Public <br /> Hearing on April 24, 2013, the Zoning Board of Appeals voted unanimously to <br /> grant a Special Permit to allow for the proposal. This Decision is conditioned <br /> upon compliance with the following: <br /> • Final Board of Health approval as stated by the Assistant Health Agent. <br /> "There is no restriction on the number of bedrooms, however more than <br /> five bedrooms will require a denitrification unit." <br /> • Is compliant with the dimensional requirements of the building inspector <br /> and is not substantially more detrimental than what exists today. <br /> • Has adequate parking. <br /> • Is conditioned upon compliance with plans that refer to this project <br /> entitled; "Proposed Sewage Disposal System", drafted by Cape & Islands <br /> Engineering, 800 Falmouth Road, Suite 301 C, Mashpee, MA 02649, plot <br /> plan for Rachel Martin Hicks et al Tr, Hicks Family Revocable Trust, 47 <br /> Orchard Road, Mashpee, Massachusetts, Scale 1" = 20' dated March 28, <br /> 2013, File No. 158MA, Septic File No. 77, Plan 032813, PCS File, <br /> orch47, dated March 28, 2013 signed by David Charles Sanicki, <br /> Registered Professional Land Surveyor. <br /> 2 <br />
