Public Hearing <br /> Applicant-Willowbend Development Corp. y' <br /> Location: Between Sampsons Mills Rd.,Herring Gull Rd., Simons Rd. and <br /> Shoestring Bay. <br /> Request: Approval of modification of Special Permit,419 opened a 7:07PM <br /> Public discussion was opened at 7:07 PM. Mr. Jack McElhinney,Willowbend <br /> Corporation Executive Vice President and General Counsel stated that he had <br /> only seen the letter from Mashpee Town Counsel on Monday, 9113199. E <br /> Willowbend has forwarded the letter to their counsel in Boston as they believe ;L <br /> there are a lot of"misstatements of law" and a lot of"relevant facts that Mashpee <br /> Town Counsel is not aware of'. This letter stated that the modification request is <br /> not grandfathered and should come under current zoning regulations and that <br /> Willowbend is a For-Profit organization in a residential zone, not commercially '��{i;= <br /> zoned. There is a 1995 Definitive Plan signed b the Planning Board which ` <br /> � y g <br /> shows all of the 21 lots that are at issue. Mr. McElhinney disagrees with Mashpee <br /> Town Counsel that there is no provision for amending the zoning bylaws. Mr. <br /> McElhinney states the 1987 zoning bylaws, section 9.3, changes or deviations can <br /> be made with unanimous approval of Planning Board. Mr. McElhinney requested <br /> to proceed with article as it applies to all golf courses. <br /> Proposed: There are 57 current approved house lots as part of original permit. <br /> Willowbend wants to replace those house lots with 9 additional holes of golf. Mr. ' <br /> McElhinney showed view from Shoestring Bay and a view of the golf course. Mr. <br /> McElhinney brought with him, to be available for questions,the following people: <br /> Tony Faragamo,Master Plan Consultant; Michael Manes, Civil Engineer; Randy <br /> Hart, Traffic Engineer; Peg Fantasia, Wetlands Permitting; Charlie Atoll, i; <br /> Environmental Science Services(developing integrated golf course Management `` <br /> Plan). Mr. McElhinney stated that by eliminating the house lots, septic systems <br /> would be eliminated. <br /> Issue 1: Traffic-Willowbend has conducted peak hours,week day and week end, <br /> summer traffic counts which showed a 10-20%net reduction if a golf course is , <br /> built instead of 57 new homes. Willowbend is working with the Cape Cod h <br /> Commission to do a full blown traffic study. Willowbend is looking for board <br /> and abutter input regarding traffic impact. <br /> 5 <br />
