i <br /> ■ <br /> The Town Planner made reference to existing detailed <br /> landscaping plans with e fisting trees identified. <br /> Mr. Quinn spoke to the dangers of attempting to sage <br /> large trees located too close to the foundations . The <br /> Applicant has made every 'effort to preserve trees in the <br /> well areas , He mentioned the favorable comments received <br /> from Phase IB la.ndscaping now that it has all grown in. <br /> r. Quinn made reference to the open space area <br /> pointing out the oversized/large existing trees the <br /> Applicant would life to preserve. <br /> Mr. Quinn suggested staking the buildings, marking the <br /> large trees, and them submitting a landscaping 'plan. <br /> Attorney Taipale continued with condition 1 - with <br /> reference to the cash performance guarantee, he suggested <br /> withholding occupancy permit's is a significant incentive to <br /> completing the work. To further impose a cash guarantee on <br /> the Applicant is excessive and unnecessary. <br /> The Town Planner clarified the existing special Permit <br /> states nothing in the next phase is to be approved until <br /> and unless the certificate of compliance has been <br /> completed. <br /> Mr. Quinn stated Applicant considers the requirement <br /> for a cash guarantee to be "'massive overkill", aind further <br /> stating the Board has allowed withholding occupancy permits <br /> in a previous phase . <br /> Attorney Taipale pointed out there is an agreement <br /> with the Trustees for the completion of the landscaping. <br /> The 'down Planner made reference to the original <br /> detailed landscaping plans for the project, which plan has <br /> nearer been modified. <br /> In response Mr . Quinn stated said landscaping plans <br /> are useless because Phase IB and Phase II have been <br /> completely changed. <br /> The Town Planner disagreed with the previous <br /> statement, saying said plans are still in effect because <br /> they have nearer been chanced, they are the only plans n <br /> record and enforceable . <br /> 7 <br />
