Permit Application <br /> For Construction of Tireless Communications Tower <br /> The Chairman recognized Brian Garner, Dunning <br /> irrane, representing the Applicant, who made reference to <br /> correspondence from the Assistant Town Planner dated May <br /> 14 h with a copy to the Planning Board: <br /> Attorney Garner mentioned Town Counsel' s determination <br /> of December 1 th defining structure and their contrary <br /> opinion. He also spore to concerns regarding the fall <br /> zone. <br /> Attorney Garner spore to the Hy-.law and the <br /> impossibility of being able to screen a tower . However, it <br /> is possible to screen a facility. He made reference to the <br /> existing structure and concrete pad. He spore to the <br /> interpretations of the word "structure" and "'facility" . <br /> Attorney Garner suggested all of the facility of the <br /> proposal is to be located inside a building. He stated the <br /> _gape_ d__ mmi _sion_ has determined_ the _pr'o .ect. to -be- <br /> technologically sound and would be constructed in a proper <br /> f-a h i on . <br /> With reference to the fall zone 'issue, Attorney Garner <br /> suggested the toner could be designed to fall at a share <br /> point of 50-feet. <br /> Don Myers asked whether dr- not the foundation would be <br /> extended in order to accommodate the pad. His question <br /> being that "existing structure" would indicate no further <br /> construction would be required in order to erect the tower. <br /> Attorney Garner responded, "I don' t think that one <br /> precludes the other" . There is an ei-s-ting concrete pad <br /> and the foundation of the building. Additional work would <br /> be required in order to incorporate the proposed tower to <br /> the existing structure. It will be necessary to slightly <br /> modify an existing structure (a building) in order to <br /> incorporate the proposed toner. Any existing structure <br /> (water tower, church steeple, etc. ) would have to be <br /> modified in order to accommodate a new tower (facility) . <br /> 10 <br />
