In response to a question asked by Don Myers, Mr. <br /> Quinn suggested a pressure treated wood guardrail would be <br /> sufficient. <br /> The Town Planner clarified the consulting Engineer has <br /> determined the proposed wooden guardrail to be inadequate <br /> for safety purposes . <br /> The chairman read from Mr. Cowley• s comment letter- <br /> dated July 1 , 2003, ""...For safety a steel guardra-il should <br /> be installed between the wall and the parting spaces to <br /> prevent vehicles from accidentally going over the top of <br /> the wall toward the tennis courts .. <br /> The chairman determined Mr. owley' s concern as a <br /> safety issue and should be addressed as such. <br /> Dennis- Pal arin-i expressed his agreement. <br /> Don Dyers suggested the possibility of alternative <br /> materials that would satisfy the safety requirements . <br /> Mr. Quinn suggested a large timber mould suffice. -- <br /> The chairman determined this matter would be decided <br /> upon safety requirements', not aesthetics . <br /> The Town Planner explained the Board could approve the <br /> draft Decision as written which refers to comments made by <br /> the consulting Engineer, and thereafter mare a minor <br /> modification to the Site Plan at a regular meeting without <br /> having to conduct a Public Hearing. <br /> There being no further comments from the Board the <br /> Chairman entertained a motion to close the Public Hearing. <br /> MOTION: Don Myers made a Motion to close the Public <br /> Hearing, Windchime Point, Inc. , approval of modification to <br /> Special Permit; which Motion was seconded by Steve Dolan <br /> and so voted unanimously. <br /> Don Myers stated his desire to afford the Applicant <br /> some flexibility and that he is satisfied with the language <br /> of the conditions being imposed. <br /> MOTION: Don Myers made a Motion to approve the <br /> Modification of Special Permit Decision as written, subject <br /> 7 <br />
