MOTION: Don Myers Dade a Motion to refer the -Lot <br /> Definitive Subdivision Plan in- this matter to the Cape Cod <br /> Commission for limited discretionary referral as <br /> Development of Regional ional Impact regarding transportation <br /> only; which Lotion was seconded by Steve Dolan and so voted <br /> una-nimou ly. <br /> The Nice-Chairman then entertained a motion to <br /> continue. <br /> MOTION: Steve Dolan made a Motion to continue the <br /> Public Hearing in this matter to October 1, 2003, at 7 :15 . <br /> p.m. ; which Motion was seconded by Don Myers and so voted <br /> unanimously. <br /> The Nice--Chairman then sired the Development of <br /> Regional Impact Referral Fora. <br /> At this point the Chairman returned to the Conference <br /> Room and presided over the remainder of the Meeting. <br /> Release of Performance Guarantee <br /> Paul J, Thomas/Wm. 'Boftito Construction Co. <br /> ilIl Farm oad,Tb e w en Bog River Bend and Turner Road <br /> Release of Covenant 2-Lots <br /> The Town Planner reported the Consulting Engineer has <br /> recommended $29, 925 . 00 to be. held as security for the <br /> project <br /> The Chairman recognized Applicantfs representative <br /> from Atlantic Development Construction who stated he is in <br /> complete agreement with the Consulting Engineer' s comment <br /> letter. <br /> The Town Planner explained Applicant is requesting <br /> Release of the Road Covenant in order to substitute with a <br /> Performance Bond. <br /> Apparently there has been some difficulty in locating <br /> an actual copy of the Covenant as Applicant has not <br /> included the date of Covenant on the Covenant Release form. <br /> The Town Planner suggested the Board sign the <br /> Covenant and hold the Covenant Release until such time as <br /> the Covenant is located. <br /> 9 <br />
