Antunes is entitled to notice . <br /> Reference was made to a Plan of Land entitled, "Plain <br /> BSC Group, Christopher Lane, Definitive Subdivision, <br /> Christopher Lane i Mashpee, MA (Barnstable County) , <br /> Grading Plan dated June 2, 2003, prepared for Chris <br /> Johnson, 14 Hinckley Road, Dennis, MA 02 6 ". <br /> The Chairman recognized Attorney Rapp who asked to <br /> spear on Mrs . Antunes behalf. <br /> Attorney -Rapp-app suggested Mrs , Antunes h -s attended the <br /> Hearings as a concerned citizen as she had not been <br /> notified or identified on the abutter' s list. He stated <br /> that property owners contiguous to Mrs. Antues property <br /> have been included on the abutters list . He requested a <br /> fair and consistent procedure. <br /> The Torn Planner asked Attorney Stapp for his Op-iin <br /> a's to how this matter.-.might -lac --remedied' at phis -point. He <br /> suggested that an abutters list be agreed upon (to -include <br /> those two property owners who were not notified) , followed <br /> by notification of the continuation of the Hearing. <br /> Attorney Morse objected on the grounds it would set <br /> the process hack months, and that her clients a-re already <br /> months into the process . She reiterated that Mrs . Antues <br /> had received actual notice, has attended the Bearings, and <br /> the opportunity to have her voice heard. <br /> Attorney Rapp agreed his client could not appeal the <br /> Board' s decision.. However, the process has been violated, <br /> Mrs. Antunes has not received notice. <br /> Dennis Balarini noted Mrs . Antunes is not the only <br /> one, that there are others who should have been notified as <br /> well . <br /> Attorney Morse stated the notices went beyond the <br /> Subdivision Control Regulations. She further -noted how <br /> unfair it would be to set this matter back another one, <br /> possibly two months. <br />
