The Town Planner suggested either waiting for the plan <br />and Mr. Rowleyfs approval; or approve with the condition <br />that when said plan is obtained, it meets with Mr. Rowley <br />approval. <br />The chairman entertained an amended motion be made. <br />AMENDED MOTION: Doan Dyers made an amended Motion -to <br />approve the proposal minor site plan change, for <br />outhape Village shopping Center, to substitute plastic <br />for concrete drainage pipes- where applicable subject to the <br />conditions outlined in Mr. Fowley' s letter dated October 1, <br />2003, and to Mr. wl ey' s approval; which Motion was duly <br />seconded by Dennis Balzarini. and so gated unanimously. <br />Voting in the Affirmative: Steve Dol.anr Don Myers, Lee <br />Gurney, Beverly Cane, and Dennis Balarini . <br />Public Hearing <br />Shellback Way Realty TrustBrynwood Associates <br />Approval of Definitive Subdivision Flan <br />- -The. appointed- hour having- -a!rri-ved-I t-he- Chairman- ca-ll;ed.. - _ - <br />the Public Hearing to order, noting the matter had been <br />procedurally denied .as a DRI on Augu-st 14, 200, and <br />continued from September 19, 2003. <br />The Town Planner made reference to a Flan of Land <br />entitled, Subdivision Plan of Land located in Mashpee, MA, <br />prepared for Shellback Way Realty Trust, by cape & Islands <br />Engineers. He stated a stipulation of Voluntary Dismissal <br />has been filed of the case between the owners of the <br />property and the Cape cod Commission regarding <br />jurisdiction. <br />Attorney Dunning ha-s suggested the new owners of the <br />property be provided an opportunity to appear before the <br />Board as a courtesy. However, no one was present at the <br />Hearing. <br />The Town Planner stated this matter would have to be <br />disapproved due to the Cape Cod Commission disapproval. <br />The Chairman then recognized the following members of <br />the Public: <br />3 <br />
