Dennis Bal aripi stated that he has no issue with the request for waiver, but that <br /> he would require the entrance be widened at Route 130. <br /> The Town Planner_:reminded the Board of another issue of concern being the <br /> width of the Broadway and reinforced shoulders. He also assured Board Members that <br /> there is a.l 0-ft. landscaped buffer required along the boundary of the open space area;:as <br /> well as building setback requirements. <br /> The Chairman inquired-as to the reason necessity of the length ofthe road, a -well <br /> as Planning Board history for granting similar waivers, and the public benefit to the <br /> current plan as opposed to former plans. <br /> Mr. McGrath explained that-the dimensions of the lot have dictated the length of <br /> the roadway, as well as trying to create various sized lots.in order to accommodate any <br /> type ofu e, and designing around the topography conditions. <br /> The Town Planner responded that the Planning Board has-granted waivers in this <br /> situation-in.the past, usually conditioned upon the basis of providing an alternatc access <br /> road in the event of emergency. <br /> Attorney Ford stated there had been-an easement to Echo Road on a prior plan <br /> that had been a requirement of the Fire Department with-regard to the 120-.40B units <br /> .currently permitted in the open space. The Fire Chief has indicated that without the three <br /> story buildings, the access easement.is not necessary provided the road width is sufficient <br /> for emergency vehicles and that there are no obstructions. <br /> With regard to public benefit, Applicant feels that the proposed plan offers better <br /> land use, for..industrial and commercial purposes for which the land is zoned(rather than <br /> the 40-B residential lots), the plan better conforms to the zoning bylaw and is overall <br /> more straightforward and will create sufficient value. <br /> There being no further Board or Staff comments the Chairman enterWned <br /> motion. <br /> MOTION: Dennis Balzarini made a Motion to approve a waiver of the <br /> Subdivision Regulations Section VII.A. . regarding the 800400t maximum length of <br /> dead-end streets, subject to: written confirmation from the Fire Chief regarding <br /> sufficient access to the property; that the roadway be widened to - et ith -foot <br /> reinforce shoulders satisfactory to the Fire Chief; and revision/widening of the <br /> entranceway t Route 1 0; which Motion was duly seconded by Joseph Mullin and so <br /> voted unanimously. <br /> M TION: Dennis B ' made a further Motion that this matter is a <br /> mandatory referral to the Cape Cod Commission;which Motion was duly seconded by <br /> Joseph Mullin and so voted unaninnousl . <br />
