The Town Planner noted that.-there is no mention or inclusion of the Planing <br /> Board vote. <br /> Commission Staff responded that the flow chart refers specifically to Cape Cod <br /> Commission regulation and that when this particular and individual Development <br /> Agreement is,drafted, both Cape Cod Commission regulation specific To Win of Mashp e <br /> regulation and detail 'Will be included in the process. <br /> Mr. Neid wiecki indicated that a separate document will b a prepared and <br /> submitted for Planning Board review that will incorporate suggestions made such as <br /> meeting,.locations, time-constraints, Planning Board votes, etc. <br /> When asked, Mr.Neidzwiecki stated that he envisions one Public Nearing that <br /> would be opened at the beginning.of the process and continued through completion. <br /> There are no overall time constraints for completion of a Development Agreement under <br /> Cape Cod Commission regulation. However, minimum time frames between specific <br /> steps of the process can certainly be identified. <br /> The Chairman requested a newspaper re-advertisement of the continued Public <br /> Hearing during.the time period between Steps 4 and 5. <br /> In addition, Dennis Bal a rini suggested a press release be published in the local <br /> newspapers informing the-puhl is of the upcoming Public Nearing, with-a full explanation <br /> of the proposed project and those.issues of concern impacts open for discussion. <br /> Ms. Senatori explained then step in the process would be involve a Public <br /> Nearing with the full ] -Member Commission, to be conducted in Barnstable at <br /> regularly scheduled meeting. Also, the Commission wil l receive all of the information <br /> submitted for the record, including all minutes and testimony of Public Leanings, d <br /> Subcommittee Meetings, prior to making a final decision. She:also-stated the Planning <br /> Board will receive a full Commission Staff`Report prior to the first Public Nearing. <br /> If the-Development Agreement is approved at.this point,-it would be-submitted to <br /> the Town of Mashpee for approval by a majority vote of the Board of Selectmen. <br /> (Development Agreement becomes effective upon appropriate recording.) <br /> There was brief discussion regarding the Regional Polio Plan performance <br /> standards. 11r. Ieidwieci stated there is a Flexibility Clause within the Cape Cod <br /> Commission Act. He also stated that.-the Plannhg Board will have more ability to <br /> negotiate impacts/mitigation, concerns that have been raised regarding.the critical and <br /> sensitive issues with the Trout Pond parcel, etc. for the Town through a Development <br /> Agreement process. <br /> At this point the Chairman suggested the Planning Board Special permit Dearing <br /> be opened simultaneously with Step#1 of the Cape Cod Counission Flow Chart. <br />
