Mr. Rowley was contacted by Down <br /> Cape Engineering during the preparation of said plan. <br /> The Town Planner clarified that this-matter is a Definitive Subdivision Plan <br /> Modification for a street (not a driveway). A paved road has been proposed to a certain <br /> point after which gravel would be used, based upon the Fire Access Bylaw. Applicant is <br /> requesting vanan a from said paving requirement from the Z A. <br /> The Zoning Bylaw requires the paved road; and Subdivision regulations also <br /> require a 20-ft. wide paved road. The Planning Board will not know-the conditions of the <br /> final plan until such time as the Z A grants a variance. The Planning Board needs to. <br /> make a deteriination as to whether or not the road is to be pared according to <br /> Subdivision Regulations. <br /> Thomas "Hara asked if Lori Dane provides access to the pond for the abutters. <br /> His concern being the possible denial of access cline to construction of a reta ng vial1. <br /> e also questioned whether or not Applicant would have adequate frontage in the event <br /> the street becomes a dead-end. <br /> There was Board discussion in this regard recognizing that said retaining walti <br /> not being proposed to keep people out, but rather to contain the driveway area due to the <br /> slope of the land. <br /> The Town Planner responded this is a zoning issue; also this particular lot is <br /> grandfathred. The Planing Board has to decide ghat type of construction of the street <br /> is required under the Subdivision Regulations, which primarily addresses the issue of <br /> providing adequate access to a lot in order to avoid a land locked situation. <br /> The Town Planner also reminded the Board of their ability to waive Subdivision <br /> Regulations. <br /> At this point the Chairman recognized Dan Ojala, Land Surveyor/Civil Engineer <br /> with Down Cape Engineering,representing the Applicant, who informed the Board that <br /> he is making.an attempt to address those comments made by the Consulting Engineer. <br /> Mr. Ojala addressed those changes made per Mr. I o rrley's concerns: There will <br /> be a paved apron regardless of the decisions made by the ZBA and Planning Board. <br /> There will be a catch basin in the center that will feed into a trench drain. <br /> Mr. Ojala further informed the Board that he will revise the plan to show a detail <br /> indicating pavement over the top if there i s to b .pavement, and open trench if gravel is to <br /> be used. Mr. Rowley has also suggested the use of a filter fabric, which will also be <br /> indicated on the plan. <br /> Mr. ojala addressed the issue of the slope, stating that the Conservation <br /> Commission has requested the area not be seeded.
