- Mr. Bunker explained said plan was approved by the Planning Board in larch of <br /> 00 , but was not recorded within the six-month time period. <br /> Mr. Rowley suggested the Board make a deteuination that no charges have been <br /> made to the plan as approved in March and re-sign the plan for recording purposes. <br /> After brief discussion the Chairman entertained a motion. <br /> MOTION: Dennis Balzarini made a Motion to approve the re-signature of the plan <br /> entitled, "Subdivision Plan of Land in New Seabury, Mashpee, NIA, prepared for <br /> Bayswater Seaside LLC, by B S S-Design, dated February 13,Zoo " for recording purposes; <br /> which Motion was duly seconded by Myrna Duey and so voted unanimously, <br /> esignature by Beverly Kane, Dennis l alza ini, and Myrna Duey. <br /> Preliminary Subdivision <br /> Scott Bauer—8 Blue Castle Drive <br /> Subdivision of One Lot into Two and Approval of Easement <br /> The Chairman called this matter to order and recognized Steve Doyle, representing <br /> the Applicant. <br /> References were made to a plan of land entitled, "Preliminary Subdivision Plan <br /> prepared for Scott Bauer in Mashpee, NIA, by Stephen I Doyle &Associates, dated <br /> December 10, 007"). <br /> Mr. Doyle indicated the location of the water main for which there is no easement. <br /> He is proposing the creation of an easement, as shown on the plan, on Lot 1 OA noted as an <br /> 1 -f . wide utility easement. There is a second-easement area located in Lot 1 OB which is <br /> approximately 0-square feet. <br /> Mr. Doyle is under the impression that the Zoning Bylaw would allow an easement <br /> area into a lot area if it is less than 20-f . wide. The Subdivision Regulations however <br /> require the easement be a minimum of 20- t. wide. He requested approval of a subdivision <br /> waiver with regard to the -ff. requirement. <br /> Recognizing the fact that-the street has been laid out ina wrong location and efforts <br /> are being made to relocate the street, Thous "Tura stated he feels this is a situation <br /> whereby a waiver should be approved; to which Joseph Mullin and Myrna Duey agreed. <br /> Mr. Rowley-questioned whether the easement would be granted to the Town <br /> (Nlashpee water District)and if this would require Town Meeting approval. The Planning <br /> Board can show the lines of easement on the plan and then address the legal aspects of <br /> conveying said easement. <br /> 10 <br />
