The Board advised Applicant to review the Preliminary Plan checklist with the <br /> T� Town Planner for feedback, and to contact I star regarding the utility easement. ---— <br /> Performance Guarantee <br /> Release of Performance.Guarantee—Prime Properties <br /> The Chairman called this matter to order and determined that Applicant was not <br /> present. <br /> Mr. Rowley suggested he male an inspection as to the condition of the properties a <br /> some date back to 1993, and report back to the Board as to their status. <br /> Performance-Guarantee <br /> Release of Road Covenant; <br /> Bayswater Development LLC—Flat Pond Subdivision <br /> The Chairman called this matter to order and recognized Torn Bunker, BSS Design, <br /> representing Applicant. <br /> References,were made to a plan entitled, `'Lotting Plan Flat Pond I; efmitive <br /> Subdivision Plan, Ma tepee, MA,prepared for Bayswater Development, LLC,b r Earth <br /> Tech,dated 01 o � . <br /> Mr. Bunker informed the Board that Plat Pond Subdivision has been approved with <br /> notation adding a certification which the Town Clerk has signed verifying there has been <br /> no appeal. Said plan is subject to a covenant. <br /> Mr. Bunker requested Planning Board signature of the Mylar plan. He also <br /> provided the covenant. <br /> Mr. Rowley suggested the Board sign the Mlar and hold it until such time as the <br /> Town Planner has verified that all construction work in connection with the covenant has <br /> been completed and that the amount of security is referenced to the proper plan. <br /> Mr. Rowley expressed concern regarding the completion of top course pavernent, <br /> drainage issues, and minor issues such as street signs and verification of bounds. <br /> Having determined said plan was approved on November 7, 2007, the Chairman <br /> entertained a motion. <br /> MOTION: Dennis Balzarini made a Motion to sign the plan entitled, "Lotting Plan <br /> Flat Pond:Definitive Subdivision Plan, Mashpee MA, prepared for Bayswater <br /> Development, LLC, her Earth Tech, dated o 1 07, subject to an arnount of se urity for the <br /> remaining construction work to be completed and posted with the Town. Said plans are to <br /> he held at-the Planning Department until such time as the security issue has been satisfied. <br /> The Motion was duly seconded by Myrna Nuey and so voted unanimously. <br /> I <br />
