i
not conform to the newly agreed upon regulations as it was
approved some time ago' .
it. Bonvie suggested said approved street, Clubside
Court, not be constructed. He made reference to the
setback limes in proximity to the wetlands . He also made
references and raised concern-s regarding the edge of road
and buildings with reference to the restricted zone. Are
attempt has been made to have thi-s area declared a vernal
pool, which request has been denied at the state level .
This area, however should be treated as a wetland, if not
an official vernal pool .
Mr. Bonvie informed the Board that he has met with the
Town Planner and the Landscape Committee, the trees have
been flagged in the field, and the plans have been revised.
to reflect the changes . references were then made to a
plan entitled "New Design" .
r. Bonvie suggested the road approved as Cluside
Court be eliminated from the plan, displace four 4 uni-ts,
to be constructed in another phase, and build on the
frontage. This revision would remove any construction from
the restricted wetland zone.
While inspecting the site, Town Planner made a
suggestion to remove one of the duplex buildings and
construct -a quadruplex in order to Crary the building sizes
and to preserve some of the existing large trees.
The area wa-s then re-flagged to reflect this
suggestion. At this point one of the unit owners suggested
there is a vernal pool within the wetland at this location.
Upon investigation a sinkhole was discovered that has
been used for street drainage purposes over the past
fifteen years and is currently holding a lot of water. The
Conservation Agent was invited out to inspect the area in
question and declared the land is subject to flooding, he
was uncertain however if in fact it qualifies as a Vernal
pool . The Conservation. Agent was reported to have said
that if the area is not currently a vernal pool that it
will soon -become one. He suggested the area be treated a
a vernal po l, and suggested the developer 'revise the plan
as if it were a vernal pool, if possible.
5
