"' <br /> He- staved he is uncertain as to the legality of this <br /> matter. if there were a performance bond security in <br /> place, there would be a time limit in place; however, there <br /> is no time frame placed upon a covenant . Also, the <br /> regulations state that the Planning Board may, on its own <br /> motion, rescind, modify, or amend the subdivision. The <br /> process is identical to that of creating a subdivision. <br /> Mr. Toney suggested the -Board obtain an opinion from <br /> Town counsel in this natter. <br /> Discussion - Water (duality Issues <br /> In an attempt to address water duality questions for <br /> the Blue Ribbon. committee, the Chairman shared some <br /> concerns expressed by Ed Baker regarding road runoff. <br /> Mr.. Baker ha-s stated there are breaks in roadside <br /> berms at Route 130 and on Quinaquisset at the Iashpee <br /> River. There are berm breaks on both sides of old Mill, <br /> amp ons Mill Road, where it crosses the Santuit Fiver <br /> adjacent to the Wampanoag Center. <br /> The chairman .asked if it would be appropriate for the <br /> Board to request an inspection be made by the Consulting <br /> Engineer on these points and report back to the Board with <br /> his recom endatioans findings. <br /> She suggested the Board make a recommendation to the <br /> DPW, directed through the Blue ribbon Committee, in an <br /> attempt to improve water duality. <br /> The Board agreed to request said inspection be made b <br /> the Consulting Engineer, in writing, with a copy to the DPW <br /> Director, for his information. <br /> Request for covenant l elea-se <br /> Radcliff load -- Lot 412 <br /> The Town Planner explained he has had a request for <br /> Covenant Release for a lot on Radcliff Road.
