Other Items Request for Enforcement - Notre Dane Lane The Chairman made reference to a possible violation and request for enforcement action on Notre Dame Lane by Randall Moore, a%s written to the Town Planner. It appears that the developer has not complied with the terms of the special permit that require the open space land be donated to the Town or the owners' association at the completion of construction. The Chairman entertained a motion to request the Zoning Officer to enforce the conditions of the Special Permit. MOTION: Lee Gurney made a Motion to request that the Zoning Officer enforce the conditions of the Special Permit in this matter; which Lotion was duly seconded by Dennis Bal arini and so voted unanimously. Performance Guarantee Bayswater Development, LLC - Flat Pond Subdivision The Chairman called this matter to order and recognized Joe Colasuonno, Project Manager, representing the Applicant, who requested release of the Security for the Flat Pond subdivision. The Chairman made reference to a letter received from Mr. Rowley dated September 19, 2006, recommending Planning Board release of security in the amount of $12.4, 695 . 00, which is 1 f $83, 130 . OD for the specific items indicated oft contractor letterhead; and that the Planning Board a s-t bli sh a t i e f r me for the completion. of the work in conformance with the provisions of Ch. 41, sec. 1 U. The Board agreed on a t ime fr me for completion of construction of one (1) year, October 1, 2007, with the possibility of filing for. an extension, if needed.
