Talanian Realty Co. , Inc. - Shellback Way <br /> The chairman called this matter to order and <br /> recognized Mr. Megathlin, who spoke to the matter of a <br /> Performance Guarantee issued to the Town. -f Masbpee <br /> approximately one year ago for Shellback Way. <br /> Mr. Megathlin stated a guarantee in the amount of <br /> 2, 80 . 00 is in place. Mr. Taylor, the DPW Director, <br /> approved this amount . Thereafter the Zoning Board of <br /> Appeals approved a plan that was different from the plan <br /> approved by the- Planning Board. The Planning Board <br /> required an amount to include the costs for loam and seed <br /> of sidewalks, to close curb cuts, and for improvements to <br /> the parking area at the Hardware .Store location. <br /> Mr. Megathlin informed the Board that the majo-rity of <br /> work has been completed. However, some of the work has not <br /> been completed. Eastern Bark has signed a 20-year lease <br /> and ha-s no intention of closing the curb cut . It is his <br /> understanding that the Hardware Store also has a long-term <br /> .ease. <br /> Mr. Megathlin requested the entire amount of <br /> $2, 880 . 00, plus interest, to be returned. <br /> There being no further discussion the Chairrrian <br /> entertained a motion. <br /> 1 <br />
