The Town Planner distributed copies of the Site Plan, <br />and Town Planner Draft Special Permit Decision dated <br />October 3, 2006. <br />Perfor.mance guarantee <br />Bayswater Development, LLc <br />Flat Pond Subdivision -Release -of Road Covenan' t <br />T-he Chairman called this matter to order and <br />recognized Joe cola-suonno, Project Manager who requested <br />signature of the Release of Covenant, <br />The Town -Planner reviewed that at the September 2, <br />2006 Meeting the Board voted on an, -amount of $124,695.00 <br />se'cur-ity for Flat Pond. The Board did bot vote or sign <br />Covenant Release at that time. <br />The Town. Planner e planned to the Board that Applicant <br />is r:equestir g the posting of a bona for security. He <br />suggested the Board vote on the covenant Release, -and sign - <br />the release forms which he would hold until such time a-s <br />the security. issues have beer' agreed to. <br />There being no further discus-sion in this -matter the <br />chairman entertained a motion. <br />MOTION: John Halachis made a Motion to approve the <br />Release of Road, coVenant , subject to the submission of a <br />cash/bond Per-fo,rmance uara-nte,e for Lots 1-30 at Flaat Pond <br />Subdivis-ion in the amount of $12-4 ; 7 . o ; which Motion was <br />duly seconded by Den-ni s Bal a r.in-i and so voted unan-imou- sly . <br />Having determined this to be the free act and deed of <br />t-he Board, the Board Secretary duly notarized three 3 ) <br />copies of "'Planrhing Board Town of Mashpee Release of <br />Covenant Agreement, Lots 1-30 Flat Pond -New Seabury <br />Properties, LLc"'.
