Ta l ani an Realty Co. , Inc. <br /> South Cape Village Building F-2 <br /> Having been previously approved the Chairman, Beverly <br /> Kane, signed one original and' five copies of this document . <br /> Having determined that this was the free act and deed <br /> -of the Mashpee Planning Board the Board Secretary duly <br /> notarized all copies . <br /> Public: Hearing <br /> Stratford Ponds Condominium Association <br /> Stratford Ponds Condominiums - Route 130 <br /> Modification of the Special Permit <br /> The appointed hour having arrived the Chairman read <br /> the Public Hearing, notice into the record and called the <br /> Public Hearing to order. <br /> The Town Planner stepped down from this matter in <br /> order to avoid any possible con-flirt of interest, as he is <br /> an abutter to the property. <br /> The Chairman then recognized Attorney Schaeffer, <br /> representing the Applicant, who stated the only outstanding <br /> legal issue is whether or not the original developer <br /> created a deed restriction for the open space area. It i <br /> his understanding that there is- no disa Free ent with Town <br /> Counsel that this matter was properly addressed by the <br /> original developer (although Attorney Schaeffer did not <br /> have. this determination In writing) . <br /> Attorney Schaeffer then deferred to the Assistant Town <br /> Planner who informed the Board that Town Counsel has <br /> as-sured hire that the Town' s interests are protected without <br /> requiring Applicant to file a formal conservation <br /> restriction. <br /> 3 <br />
