Section IV Has been satisfied:The proposed location is within the Mashpee wireless overlay district.It has been <br /> demonstrated that there are no existing structures on which to locate.Documentation via a primary land lease <br /> designates control and legal right to perform this development at this location. <br /> - Section V subpart C,D has been satisfied:Due to the proposed location is in a Wireless overlay district the tower <br /> height is allowed to be 150'which this proposed tower complies with. All property line setbacks have been met in total._ <br /> The 50%building setback has been met in total.The existing building will be used as the equipment shelter thus <br /> eliminating the need for an additional building.There will not be any active use of the existing building within the 50% <br /> fall zone.That is to say there will not be any commercial or retail use of the building within 75'of the proposed location <br /> of the tower.The tower will also be designed to have a new failure point at 75'providing an additional safety factor as <br /> deemed appropriate by the subcommittee(see attached memo from Summit MFG.) A variance will not be required since <br /> the 50%fall zone is met and the bower will be an extension of a pre existing non conforming use. <br /> Section Vlall subparts have been satisfied: <br /> 1. No camouflage will be required as the tower will be hot dipped galvanized and has been approved by the <br /> subcommittee. <br /> 2. Due to the proposed location of the project is in a developed Industrial location,the subcommittee has approved <br /> the vinyl visual barrier slats as an adequate buffer. <br /> 3. The color of the tower has been approved by the subcommittee. <br /> 4. All equipment shelters and BTS equipment will not be visible.They will be installed inside the existing building. <br /> 5. No lighting will be required and signage as submitted with the application has been approved by the <br /> subcommittee. <br /> 6. The project has been filed and approved with the MHC and does not fall in an Historical district. <br /> 7. The proposed tower does not impact and scenic Landscapes or Vistas as seen by the photo simulations provided <br /> and approved by the subcommittee. <br /> 8. All noise standards fall below the Technical bulletin and state mandated requirements. <br /> 9. All Radiofrequency standards fall below the technical bulletin and state mandated requirements. <br /> 10. All Hazardous material standards have been met with appropriate conditions designated for fueling,digital <br /> thermostats and incandescent lighting. <br /> -Section VII has been satisfied in total:A survey of all existing structures has been complete;contact with all six <br /> licensed carriers has been accomplished and the design of the structure will accommodate a minimum of six carriers <br /> for future growth capacity. <br /> The Facts about the Project <br /> It is a FACT that this project has met all filing requirementsprior to any other application.This can be validated by the <br /> Mashpee Flanning board. <br /> It is a FACT that this tower with its height and location is as safe interms of Aviation safety as ANY other tower on Echo <br /> Rd.This is validated by global approvals from ,FAA,FCC,TERPS,Major Dolan-Flight Commander Otis AFB and Lt. <br /> Colonel T.Mullen-Otis AFB. <br /> It is a FACT that through structural engineering the tower is designed to fail at a point ten feet below the 150'AGL and <br /> the tower will"React"in a manner described by the tower manufacturer.It is also Fact that unlike trees or buildings, <br /> these structures are engineered and structurally designed to withstand loads that trees and buildings cannot.This is <br /> validated via updated correspondence from Summit Manufacturing attached hereto addressing the concerns denoted in <br /> the Subcommittee report by your consultant David Maxson. <br /> It is a FACT that those bringing,to.light the safety of the tower in relation to a building not only utilize prefabricated <br /> shelters of their own,at the base of the tower but they also have what appears to be a 200- 250'(possibly extendible <br /> even higher) lattice tower 20- 30 feet away from their corporate headquarters off route three north,in Marshfield <br /> where many if not all the employees work from. <br /> It is a FACT'that the existing building being.used to house the equipment shelters is analogousto any equipment shelter <br /> at the base of any tower in terms of its use and proximity. <br /> It is a FACT this tower is less visible than any other tower located within the wireless overlay district in Mashpee and as <br /> a result meets the intent of the RPP more than any other tower proposed. <br /> It is a FACT that there will not be any clearing of any vegetation whatsoever at this location. <br /> It is a FACT that 150 feet AGL height is required for maximum co-location of six carriers thus mitigating the need for an <br /> additional tower in this location. <br />
