f <br /> Blink Road <br /> John MeElhinnev, Vice Presid nt willo bend was present. <br /> There is a prior approved.subdivision 1n this location and a posted million bond for the road <br /> which they would like to ()ret released. <br /> He presented a.plan in order to formal l r abandon that subdivision. It is an ANR plan removing <br /> the two roads. <br /> Ever one discussed the best process. Tom thinks this should be done as a modification ofthe <br /> prior dfinitive plan approval. If done as an Afl , there are 2 plans on record. The road'needs to <br /> be eliminated to release the bond. <br /> Also, the boundary line is missing on the plan, needs other existing lot lines. <br /> The.Board can waive the preliminary plan and go right to definitive process. <br /> Jack would like to avoid notifying all abutters because that is a major process. They just want to <br /> put on record that the road is Bing abandoned. <br /> Tom said abutter notification is necessary even with a modification. <br /> Mr. McElhinney agreed with the process. They will file the plan at the next meeting. This-was <br /> put on the agenda for June 19th. <br /> DISCUSSION <br /> Applicant: Theodore Schilling/Jack Schilling/Jack McElhinney <br /> Location: 54 Gullane Road <br /> Request: Discussion of pool encroachment on Willorbend open.space and potential for <br /> special permit modification <br /> Attorney Schilling was present representing Scott Bearse, homeowner on Gull ne Road. Mr. <br /> McElhinney was also present, he explained Mr. Bearse.has an issue with the pool construction at <br /> h.is home. Willowbend previously granted him an easement but-it was discovered that the <br /> easement encroached onto the open space, about&total of 6,,000 sq feet. willowb nd is willing <br /> to swap another piece of open space-for this one. <br /> He presented a plan of the house, lot 49, in the vi nit r of the clubhouse. <br /> Mr. McElhinney presented a plan of the proposed property to be scrapped. It is a lot which will <br /> not be built on. Thev will swap a small piece of it: <br /> He looked to Tone's advise as to,how to do this most simply, <br /> The Board members have not.problem with the swap. <br /> Worn proposed: <br /> - to change the lot Iiens, they need to-do an ANR <br /> - mint modify the special permit. Reviewed red the rules re: major and minor change. Everyone <br /> agreed this is a minor change-which..does not requireA public hearing. <br /> This project is under the cluster subdivision rules. <br /> Torn -mentioned-a flavorin this special permit because open space is supposed to be restricted, <br /> enforceable by the town. <br /> Mr. McElhinney said there is a restriction enforceable by the town, subject to willowbend <br /> ability to "Mv&k-it" which they have done several tunes before. <br /> Charlie thinks the pool should be shown on the plan and show-the set backs to the lot lines so <br /> there is no question in the future. <br />
