Gr The applicant will return to the June 1 ' meeting to complete this. <br /> Attornev Schilling explained the applicant is trving to close a transaction on this property and the <br /> buyer would like to know if the Planning Board is in agreement with this proposal. He has an <br /> assent statement drawn up. that will allow the eas m nL that he would like the Board to consider <br /> this evening. <br /> Tom said the Board does not vet kn w what they are getting in return. it is not just the easement <br /> issue for the pool, it is an encroachment on the open space. <br /> Dennis said the Board can onlv tell them thev agree in concept but not willinu to sign anything <br /> this evening_ <br /> i <br /> Re-open the Thomas/Costa public hearing <br /> Steve 's very disappointed there has been no input from the applicant who has mussed 3 meeting. <br /> Dick made a motion to den} the application for the ? lot subdivision because the Board does not <br /> have a revised plan to vote on and has never seen it. The applicant is making a mockery of the <br /> process. The Board cannot vote on something.that is not in front of u . <br /> This is the third time a meeting was scheduled,with the abutters present. <br /> Steve is concerned about issues brought up that the applicant has made not attempt to explain to <br /> the Board., especially the stump dump. <br /> Torn thinks if there is a.stump dump its in the area ofthe road way. Mr. Hendficks agreed, the <br /> lots are in a fully wooded area. , <br /> Mr. Arthur I eP ul was present, he was involved in the development of Childs River East and <br /> West. To his knowledge there are not stumps in this location. He explained also that fir. <br /> Thomas was working but thought the engineer sent a note that he had another obligation. <br /> The Board did receive that note but must take action on the plan this evening. <br /> Mr. Thomas was on the phone but the Board explained that a phone call is unacceptable. <br /> The owner can give a written request for extension oftime, which the Board has not received. <br /> ** Steve made a motion to den} the 2 lot definitive subdivision plan for 5.3 acres off Bog <br /> River Bend because they do not.have:the plan before then; the applicant has not <br /> appeared at a scheduled public hearing three times; concerns from Charlie fowler a <br /> stated m his letter and concerns from the Board of Health and concerns over stump <br /> durnp at that Iot aation. They cleared the area and it started to erode. The Planning Dept. got a letter from a <br /> Tnwee. <br />
