satisfactory completion of such improvements within such period of time, if any, as the Board <br /> may specify in its decision. <br /> A total or partial release from the performance guarantee referred to in the previous paragraph <br /> may be obtained when the required improvements are complete, in whole or in part, as set <br /> forth in the bond or at the Board's discretion. <br /> < < _ In the event that the applicant fails to perform satisfactorily the requirements set forth in the <br /> special permit decision, or any written agreement regarding said performance guarantee, within <br /> the specified period of time, if any, the then outstanding principal amount (Penal sum) of the <br /> bond shall be payable to the Town as provided by law, to the.extent of the reasonable cost o <br /> the Town of the completion of the improvements required under the bond. In such case, the <br /> approval by the Board of the special permit may also be rescinded following the procedures <br /> provided by law. <br /> Section ICI <br /> I AMNCES OR WAIVERS <br /> variation or waiver of the requirements of these regulations, except where they are mandated <br /> by the General Laws or the Iashpee Zoning By-law, may be permitted upon written request of <br /> the applicant, by a favorable vote of at least four of the members of the Board at a public <br /> meeting when, in the opinion of the Board, topography, proper engineering, aesthetic or <br /> natural resources impacts or other-considerations necessitate such variation or waiver. <br /> Section III <br /> VALIDITY AND REFERENCE <br /> The invalidity of any section or provision f these regulations shall not invalidate any other <br /> section or provision thereof. <br /> For matters not covered by these Rules and Regulations, reference is made to the Mash pee <br /> Zoning By-laves and to Chapter 40A of the General Lags. <br /> section XXXI <br /> FORMS <br /> s indicated in these regulations, the filing of forms is required -for a number of steps in the <br /> process of having applications approved. These forms may be obtained.-at.the _office of the <br /> Town Planner. The following forms are available and are required for the action or approvals <br /> indicated. Unless otherwise stated in the rules and regulations or the Mashpee Zoning By-law, <br /> all forms shall be flied in triplicate. <br /> Planning Board Special Permit Application <br /> Planning Board Special Permit Modification Application <br /> Application for Waiver of Planning Board.Regulations <br />
