" <br /> This matter was a Zoning Board of Appeals permit, requiring <br /> approval by the Planning Board under Town By-law. <br /> The Town Planner argued the changes in the proposed plan <br /> would require a Modification, the original approved site plan has <br /> nearer been changed. <br /> W. +larsters- agreed the original plan had been approved i <br /> 197 ; with a modification in 197 no copy available) . <br /> The Town Planner produced a plan dated 1980 reflecting <br /> changes to other areas of the project, elimination of <br /> condominiums which were replaced with single-family dwellings, <br /> reflecting the original 1973 layout. <br /> The original Special Permit shows condominium units, not <br /> single-family lots. Such a substantial change would require <br /> a Modification of the Site Plan approval . Cape Cod Commission <br /> approval would also be required. <br /> The original Special Permit, as well as Subdivision Control <br /> Laws require Subdivision Plans be submitted to the Plying <br /> Board. <br /> Mr. Parsters requested permission to show the current plan. <br /> The Town Planner explained a► Definitive Subdivision approval <br /> is in front of the Board. <br /> The two plans were compared; there was discussion as to who <br /> would determine whether or not this matter qualifies as a <br /> modification. <br /> r. tasters suggested this matter be heard before the <br /> Zoning Board of Appeals for determination. <br /> The Town Planer determined Substantial Compliance, Cape Cod <br /> Commission is the issue in this matter. StAndard #2 states, ff . . . <br /> the changes do not result in requirement for additional local <br /> deve 1 opTent permit review in the form of a new permit approval, <br /> or a modification- to the original approval" . <br /> The following members of the public were recognized by the <br /> Chairman <br /> Dr. Thomas inquired as to the -width of the open space. The <br /> Board responded, "Thirty Peet" which was the By-law requirement <br /> in 1978 . (If approved, the proposed plan shovers Forty Feet,, with <br /> an emergency connection to Payarnps load with a gate at the <br /> entrance to the connection. <br /> -2- <br />
