Attorney Dunning requested the Record reflect that he did <br />not raise the question of Southport, It was the proponents f the <br />Article who did so and he would have preferred the Chairman made <br />this point to them. <br />Attorney Dunning stated it is his belief that this is a moot <br />point as zoning has been frozen by reference to Chapter A) <br />Section . Also, this is inconsistent with prior Planning <br />Board action as this site has been referred to Cape Cod <br />Commission on three different occasions, where the matter is <br />currently pending. This Article constitutes spot zoning in that <br />it seeks to change only two of the seven C-2 areas. Objection <br />was made to the fact that the Article being proposed seeks to <br />shift permit granting authority from the Board of Appeals to the <br />Planning Board. <br />In conclusion, Attorney Dunning reiterated his feelings that <br />this is not a true petitioners, article, but rather a. rehashed, <br />over the transom, Planning Board article being inappropriately <br />submitted. He urged the Planning Board to take no action with <br />reference to this particular matter. If the Planning Board feels <br />strongly about this ratter, he feels the Planning Board should <br />bring the article forward, not a group of petitioners. <br />Richard Terry, Mashpee resident - He stated this is the <br />third time this matter has been brought forward by petitioners <br />(mainly Southport residents). He explained that the reason <br />Southport had been mentioned is due to the fact that the lead <br />petitioner on this Article IS Mr. Larkin, of Southport. <br />A political action committee has been involved with this <br />Article for approximately three years. An 'attack° Memo has been <br />seat out (a copy of which was provided to the Chairman.) . <br />At this point the Chairman read the following single page <br />g <br />document .into the Record: "Preserve Mashpee , update September <br />1, 2002. Pla=ing Board Public Hearing; Wednesday, September <br />18, .m. 1Mashpee Town Hall. Hearing on Limited Commercial <br />Zone. Change - The Planning Board is holding a Public Hearing on <br />the Petition Article to re -zone the land at Rte. 11 and Old <br />Barnstable Road. Local citizens submitted the petition because <br />of concern over development in the neighborhood and the need to <br />keep commercial growth in designated areas of Town. This is the <br />same article that was delayed for almost two years by Town <br />Officials, even though the language and intent is basically the <br />same as what the Planning Board itself originally proposed. The <br />Hearing is part of the process to bring this Article to the floor <br />at Town Meeting. Please urge the Planning Board Members to <br />support this Article. Article Description As Recommended in the <br />Town' s Comprehensive Plan - This Article- would convert two <br />existing C-2 commercial districts to new "Limited Commercial" <br />districts. The new districts are intended to allow commercial <br />uses that would have less impact on the Town's roadways, <br />7 - <br />
