The Zoning Board of Appeals is a quasi-judicial body <br />that someday will be called upon to interpret whether the zoning <br />ordinance as defined and adopted by the people is being correctly <br />applied, which decision must be made as judges, not legislators. <br />As a new resident to Mashpee, he cannot understand why the <br />Zoning Board of Appeals involves itself with the pros and cons o <br />public policy decision, a legislative decision. <br />Judge chub w stated he is a member of a special interest <br />group, as accused by a professional colleague earlier in the <br />evening by letter. He explained the group has an interest as a <br />neighborhood. The major concern is that present zoning provides <br />an opportunity for too intensive commercial use and that <br />what is needed is a less intensive commercial use. The Article <br />being proposed has nothing to do with the hw's project, the <br />fate of which is pending before the Cape Cod Commission. <br />In conclusion he asked that the Planning Board tape a long <br />loop into the future of Mashpee and come to the realization that <br />the current zoning is an "intolerable imposition upon the rights <br />and needs of the surrounding residential communities". <br />Edward Govoni, Zoning Board of Appeals - Stated they are <br />quasi judicial Board with the right to determine petition <br />articles regarding zoning matters; .it is important for therm to <br />understand any such article; and be involved in the writing of <br />such. <br />Sunny Merrit, Quashnet valley - "We do not approve of this <br />Art-icle and we have a room full of people who feel the same way. <br />"uashnet Valley says, 10 . " Thaank- you . <br />Realizing her error, Ms. Merrit returned to the podium and <br />stated, "ushnet Valley says, Yes." <br />Rose Carpenter, Southport - Asked about the comprehensive <br />Plan. <br />The Cha i ran explained the Comprehensive Plan had been <br />adopted by the Town and confirmed by the Cape Cod Commission, a <br />document of many years in the making. The Plan was to have been <br />implemented after being reviewed and refined. It is not a legal <br />document, but rather the vision for the Town r s future. <br />Unfortunately, review of the document has not been made. She <br />expressed her hope that this measure mould be carried through; <br />and thanked the speaker for her question in this regard. <br />The Chairman determined that a full and fain Public Hearing <br />has been completed in this matter; everyone wishing to speak <br />haying been granted the opportunity to do so.
