Petition Article 22 is exceedingly complex and constitutes a <br />major modification of existing zoning. Moreover it strips <br />certain decision making authority from the Board of Appeals and <br />transfers these to the Planning Board. As you know the Town has <br />an established process whereby Zoning Article and in particular <br />far reaching and complex articles such as this -one should be <br />submitted f or review by all Town Boards. This procedure of f orris <br />all these Boards the time and opportunity to review these <br />articles and to make recommendations pertaining to them. It is <br />clear that this article is not a true petitioners' article but <br />rather has been expropriated from a Planning Board article. By <br />presenting this Article as if it were a petitioners article, a <br />process which encourages public scrutiny and review by other <br />concerned Boards is being sidestepped and in the process the Town <br />of Ma hpee is being asked to consider an Article which has not <br />had the benef it of review by those Town Boards and' which for all <br />intents and purposes has barely seem the light of day prior to <br />the Town Meeting. we feel especially firm on this particular <br />point as the proposed article seeks to strip authority from the <br />Board of Appeals without any input from the Board itself. We <br />feel that consideration of this matter on the Town Meeting floor <br />is highly inappropriate, could create the impression of <br />impermissible contact between the special interest petitioners' <br />group and the Planning Board and violates the principles -of <br />disclosure and openness which governs the public process of the <br />Town of Mashpee. For this reason we recommend that the Planning <br />Board rake no recommendations on this Article at this time. very <br />truly yours, Edward 1 . Govonl , Chairman, Zoning Board of <br />Appeals." <br />Having been read into the Record, the Chairman declared that <br />she would provide an opportunity for Board Members to co ment <br />upon the contents of the above letter. <br />The following is a chronological list of speakers having <br />been duly recognized by the Chairman: <br />Ed Larkin, 5 fettle Lame, Mashpee - Spoke to the fact that <br />a group of citizens should be allowed to present an article <br />without being challenged by Town officials. He noted there are <br />twenty-nine 2 names on the Petition, he being the only one who <br />resides at Southport, objecting to references made that this <br />matter is a 'Southport issue". <br />Mr. Larkin explained he was asked to speak on this Article <br />t Town Meeting on behalf of his neighbors Mashpee village, <br />Child' s River Association, and old Barnstable load . He is not <br />responsible for writing the Article, it was prepared by someone <br />else who had every right to do so. <br />Mr. Larkin made reference to the Local Comprehensive Plan, <br />explaining its development over a period of six years and <br />much input by Town Officials, Department Heads, as well as <br />�_ <br />
