r <br /> AMENDED_MTI-ON0, Dennis Balzarl l made a Motion to Deny <br /> approval based upon the following reasons : The proposed <br /> intersection with Route 28 violates Section 8, Subsection A of <br /> the Subdivision Regulations in that it is incompatible with <br /> neighboring conditions relative to traffic safety, dangerous left <br /> turn movements onto and from Route 28 and stacking of left <br /> turning vehicles on Route 28 in close proximity to rotary; and <br /> for those three specific concerns mentioned in the Consulting <br /> Engineer, Charles Ro ley' s letter dated October 16, 2002 . The <br /> amended Motion was seconded by Steve Dolan and so voted <br /> unanimously. <br /> Board Items <br /> vacancy - Associate mezber - No Applications have been <br /> filed. <br /> Performance Guarantee Process - To be reviewed at a later <br /> date. <br /> Michael Ciampi - Paving, Silver Leaf Lane - Homeowner has <br /> filed a complaint that the road is eroding. Although Mr. Ciampi <br /> has repaved the area, the Consulting Engineer can only assume the <br /> repaving covers pre' -existing road conditions. <br /> Mr. FLudala stated the repaving was not extended to include <br /> the entire length, or drainage structures as required by the <br /> insurance bond. He suggested `Town Counsel be notified that Mr. <br /> Ciampi is in violation of Board requirements; that the <br /> Subdivision Appeals Board has not net in two years; and request <br /> they pursue cashing the bond. <br /> Dennis Balzarini explained he has made several attempts to <br /> organize a Committee Meeting to no avail, agreeing with Mr. <br /> Fudala that flown Counsel should be notified. <br /> MOTION: Steve Dolan made a Notion authorizing Planning <br /> Staff to draft a letter to Town Counsel directing them to pursue <br /> cashing of the bond in the Michael Ciampi matter,`; which Motion <br /> was seconded by Dennis Balzarini and so voted unanimously. <br /> Signature - Zoning Map - The Assistant Town Planner is <br /> preparing a modified Zoning Map, which is not yet completed. <br /> Handout - Decision Cell Towers, Cape Cod Commission - <br /> Industrial Communications & Electronics, Inc. and Seacoast, Inc. <br /> Mashpee Development of Regional Impact, dated October ,, 2002,1 <br /> from Kathie Peters, Clerk of the Commission.
