The Chairman opened the Public Hearing in this matter. <br /> Pursuant to Massachusetts General Laws Ch. oA, the Mashpee <br /> Planning Board will hold a Public Hearing on Wednesday, <br /> Decer b r 4, 2002, at 7 : 45 p.m. at the Mashpee Town Hall, 1 <br /> Great Neck Road North to review the following Zoning <br /> Articles, for action at the December 9, 2002 Special Town <br /> Meeting: <br /> 1 . An Article submitted by the Zoning Board of <br /> Appeals, adding a footnote 21 to the Section 174- <br /> 1 Land Space Requirements Table. "21" For <br /> nonconforming structures in existence on December <br /> , 2002 in -Districts R3 and R5 which do not exceed <br /> lo, 000 square feet in area, but have at least 7 - <br /> feet of lot frontage -minimum setbacks may be <br /> reduced to 2 -feet front, 1 -feet rear, and 1 - <br /> feet sides . <br /> . An Article submitted by the Board of Selectmen <br /> amending the Section 174-31 Land Space <br /> Requirements Table be increasing allowed lot <br /> coverage in C1 Zoning District from 20 to 2 . <br /> 3 . An Article submitted by the Board of Selectmen <br /> amending Section 174-25 Table -of Use Regulations <br /> by renumbering the second use listed in the Table <br /> as subsection 174- C11 which deals with elf- <br /> storage warehouses to become subsection 174-212 . <br /> To eliminate duplication of numbering with the <br /> previous use list in the Table also numbered 174- <br /> 25G11, which deals with "screen planting" <br /> The text of these Articles may be reviewed in offices <br /> of the Town Clerk and Town Planer at Mash ee Town <br /> Hall . <br /> The Chairman recognized Russ Wheeler, Mashpee <br /> Building Department, who requested Planning Board <br /> reconimendation. He reported he has not fret received a <br /> response from 'Ton Counsel . <br /> The Town Planner interjected explaining Town <br /> Counsel has indicated difficulties with the Article as <br /> written as it violates the Uniformity Clause whereby <br /> the same rules have to apply to everybody within the <br /> same zoning district . <br /> 13 <br />
