Town Counsel has suggested they draft a modification <br /> of the Article to be presented on Town Meeting floor that <br /> would allow rather than by right, by Special Permit <br /> process . <br /> He suggested the Hoard vote against approval based <br /> upon said uniformity issue, which would allow presentation <br /> of the modification on Town Meeting floor, <br /> The Chairman recognized Jamie began, Zoning Board of <br /> Appeals, who requested the Board support of the Article, t <br /> be worked out on Town- Meeting floor, stating the Zoning <br /> Board ha-s been unaware of the uniformity issue. He <br /> explained the Zoning Hoard of Appeals reviews many <br /> situations, sometimes they do qualify for variance, and <br /> others do not qualify for hardship. The purpose of the <br /> Article is to make an attempt to relieve the Zoning Hoard <br /> agenda in 2003 . <br /> The Chairman entertained a motion be made in this <br /> ratter. <br /> MOTION: Richard Terry nude a Motion that due to Town <br /> Counsel opinion regarding difficulties with the Uniformity <br /> Clause,. the Board Grote against this Article. Doting <br /> however, Hoard acknowledgment, a reement and support of <br /> amendment on Town Meeting floor; which Motion was seconded <br /> by Dennis BaI ari-ni and so voted unanimously. <br /> The Town Planner addressed the second Article making <br /> reference to Article 22 of the October Town Meeting, which <br /> eliminated -ClSV and C10 overlay districts . Concerns have <br /> been raised by Mashpee Commons regarding C1SV overland <br /> district, which proves to reduce total lot coverage allowed <br /> in that area from 2 ' 20 . A response has been made t <br /> restore in the CISV and C10 overlay zones, in addition <br /> however the expansion includes the entire CI zone (Mhpe <br /> Commons, Deer Crossing, commercial area, Talanian proj.eot, <br /> and Ma tepee Place) . <br /> The Town Planner requested a favorable recommendation <br /> on this Article . <br /> The Chairman made reference to letter received from <br /> Doug Storrs, dated October 3 0th . regarding objections to <br /> said Article 22, asking if all Board members have had <br /> sufficient opportunity to review the request. <br /> 14 <br />
