His tower having been unanimously approved by <br /> the Commission at the subcommittee level . <br /> With regard to the fall :zone issue/variance, he <br /> continues to consider it an attachment, requesting further <br /> information from Town Counsel. <br /> The Town Planner assured Mr. Joyal that copies of his <br /> proposed plan had been forwarded to Town Counsel prior to <br /> their decision. He also clarified the word is not <br /> "attached" but rather "mounted", which is key to this <br /> is-sue. He reminded Applicant that there must be <br /> conformance with the Zoning By-law. <br /> Mr. Joyal argued that if the proposed project is <br /> reviewed through structural engineering and objectively <br /> with r.ea-son, there would be no safety issue if the o fall <br /> zone is applied. There a-re no safety issues at 100 with <br /> the tower located 1 -ft . away from the building. He has <br /> made every effort to design the structure to fall at a <br /> point that provides the o fail zone re.cuired by the By- <br /> law.
