Ok In response to a question asked by Richard Terry, the Assistant Town Planner noted the Cape- Cod commission referred all fall zone issues to the local leve-1 . The Torn Planner stated the Commission did not deal with the Town Zoning y-law, that the Planning Board now has- to do so. The Planning Board must now interpret the By-law and determine what can lie within the fall zone. Don Myers reiterated his concern regarding the location of the tower in relationship to the existing use of the property as described in information previously provided by the Applicant (building, tower, and active parking lot) . He asked if Applicant is planning t discontinue said active use of the property, particularly within' the -ft . or full t o-ft . fall zone . He also tapes exception to extending the foundation and calling it a part of the building for mounting . The Town Planner stated Town counsel has addressed the latter issue by determining it is- not mounted on the building. Both copies of the plan along with the By-law were provided for the purpose of addressing this issue. Mr. Joyal informed the Board that the Cape cod Commission had addressed the safety issues and found the proposed project to be one hundred percent safe, which is why it was approved. Zoning however, may be a different issue. There is nothing in the By-law that prohibits parking within the fall zone. Mr. Joyal stated it would b necessary for vehicles to be parked within the fall zone in order to accommodate those people required to maintain the shelters . The Town Planner disagreed with the previous statement, noting Appl ica�nt would be providing parking for business use of the property, not solely for the person mainta-ining the property. He stated the intent.,, when the fall zone requirements were written, was that nothing would be located within the fall zone except whatever relates to the tower itself. 1
